June 11. 1968 <br /> <br /> WHEREAS, Public Service Oil and Coal Company, Inc. has filed an application pursuant to Section 4-2 <br />of the Zoning Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter <br />described; and <br /> <br /> 5~EREAS, the applicant, the Planning Director and the City Manager have done all things required to be <br />done in connection with said application, and the Planning Commission has recommended the granting of said use <br />permit, subject to the conditions hereinafter stated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia; <br /> <br /> A. That the use for which the use hermit hereinafter described is sought (1) will not adversely affect <br /> the health or safety of persons~ residing or working in the neighborhood of the proposed use, (2) <br /> will not be detrimental to the public welfare or injurious to property or improvements in the <br /> neighborhood, and (3) will be in accord with the purpose of said Zoning Ordinance. <br /> <br /> B. That Public Service Oil and Coal Company, Inc. is hereby granted a use permit, pursuant to Section <br /> 4-2 of said Zoning Ordinance, for th~ construction and operation of a waste paper bailing and <br /> storage business to be located on the property described as follows: Beginning at the northwest <br /> corner of County Street and Godwin Street; thence north along Godwin Street approximately 1!3 feet; <br /> thence west approximately 25 feet to the Seaboard Coast Line Railroad right of way; thence south- <br /> west along said right of way approximately 245 feet to County Street; thence east along County <br /> Street approximately 235 feet to the point of or~gin. <br /> <br /> C. That the use permit hereby granted shall be subject to the following conditions: <br /> <br /> 1. There shall be a five foot aisle s~ace provided throughout the building From the front <br /> door to the rear door. These doo~ must never be blocked with storage. <br /> <br />2. There shall be four 2 1/B gallon water type fire extinguishers, properly installed and <br /> maintained in good working condition. These shall be placed at the following locations. <br /> <br />(a) One at the back door. <br />(~) One at the bailing machine. <br />(c) Two at the front door. <br /> <br />3. T~ere shall be no smoking in this building and "No Smoking" signs shall be placed throughout <br /> the building. <br /> <br />4. This permit shall be conditioned on full comnliance with applicable provisions of the <br /> Building Code and the Fire Prevention Code." <br /> <br />Zoning .Petition Z 68-14 - Porter and Lynn M. Livesay, Attorney <br />Fred Barley, President, Merrifield Civic League <br />Bill Bradley, re~yesenting Merrifield residents <br />Mrs. Jean Kaufman <br /> <br />The following communications were read: <br /> <br />.(a) "I own a 85 x 125 foot lot and a twenty thousand dollar house directly across Cedar Lane from <br />6~e~msnrBe~ter Hardy's proposed shopping center area. Rezoning petition Z-68-15 applies. <br /> <br /> As you may recall I appeared before your body during the Land Use Plan debate and opposed the <br />Congressman's earlier shopping center plan. Because of some recent develcoments I will be unable <br />to personally appear before you again. Acting solely as a homeowner directly affected, and without <br />claiming to represent anyone else, t have therefore reduced my comments on this occasion to writing <br />for your consideration. <br /> <br />I still oppose this ill-advised shopping center for the reasons that are already a matter of record. <br />~f you chose to allow this rezoning petition in spite of the public opposition we hope that you will <br />take appropriate stens to cut our losses thereby. <br /> <br /> Having heard the consideration the Council gave the o~mers of the One Crawford Parkway Building <br />in restricting the Marina boat sales activity ! am confident you will give favorable consdieration <br />to my enclosed proposals designed to help preserve the peace, value and safety of my home, if you are <br />going to make us endure the shopoing center."
