<br /> BE IT FURTHER RESOLVED, that the City of Portsmouth hereby agrees to pay fifteen percent of the cost
<br />of such work."

<br />~ 68-228 - "I submit the attached resolutions and recommend their adoption. These authorize condemnation
<br /> proceedings for acquisition of property needed for the London-Glasgow Street Expressway.
<br />
<br /> It is necessary that two resolutions be adopted as one parcel is in the limited access portion of the
<br /> highway at the Harbor Drive interhhange.
<br />
<br /> This action is necesaary as three of the parcels we Have not been able to agree on price and the other
<br />two hays title deficiencies."

<br />On motion of Mr, King, the following resolution was adopted, without dissenting vote:

<br />"A RESOLUTION TO PROVIDE FOR ~tE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSH~UTKU~qDER
<br />EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF ASSEHBLY OF 1966, SAID PROPERTY
<br />BEING NECESSARY FOR THE CONSTRUCTION, WIDENING-~qD IMPROVEMENT OF STATE HIGHWAY ROUTE S8 PROM THE
<br />INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO FIE INTERSECTION OF LONDON AND EFFINGHAM
<br />STREETS

<br /> ~{EREAS, in cooperation, with the Federal and State governments, State Highway Route 58 is being constructec
<br />widened and improved from the intersection of Airline Boulevard and High Street to the intersection of London
<br />and Effingham Streets in the City of Portsmouth, Virginia; and
<br />
<br /> ~EREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision
<br />of the land necessary for the construction; and
<br />
<br /> IVHEREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter
<br />specified in and to the hereinafter described parcels of land situate in the City of. Portsmouth, Viri~nia,
<br />for the purpose of constructing, widening andimproving' the aforesaid State Highway Route 58; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary
<br />to the project, because the owners thereof and t~e City have not been able to agree upon the price to be
<br />paid therefor, or the City has not been able to locate certain of the owners or because of th~ status of the
<br />title of certain parcels of the property; and
<br />
<br /> WHEREAS, advancement of the work and use of said State Highway Route 58 will be delayed unreasonably if
<br />the said property is not made available as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />Section I. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purposeif he deems it advisable, against the property hereinafter described located
<br />along State Highway Route 58, for the purpose of acquiring fee simpIe title therein, in accordance with
<br />and pursuant to Section 23(F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of
<br />Assembly of 1966), and to deposit to the credit of the court as provided by law the sum hereinafter
<br />specified to compensate the respective owners of the vmrious varcels of land, as shown on those certain
<br />plans entitled Project 0058-124-103, R/W 201 and 202 dated February 14, 1966, sheet 6, a copy of which
<br />is filed with the Department of Public Works of the City of Portsmouth,'~irgia~a.

<br />provisions of Article 5, Chapter 1, Title $5, of the 1950 Code of Virginia as amended; and

<br /> WHEREAS, one of the, obligations of the City of Portsmouth with respect ,to said project is the provision
<br />of the land necessary for the constructibn; and '
<br />
<br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinafter
<br />described parcel of land situate in the City of Portsmouth, Virginia, for the purpose of constructing, widening
<br />and improving the aforesaid State Highway Route 58; and
