AugUSt 15~ 1968 <br /> <br />.At a regular meeting of the City Council, held on August.IS, 1968, there Here present: <br />Jack P. Barnes, George D. Bastes, Janes M~ Holley, Burrell R. Johnson, Isaac W, King, R. Irvine Smith, <br />Raymond Turner, A. P. Jotmson, Jr., City Manager and M. A. Korh, Jr., City Attorney. <br /> <br />The meeting was opened with prayer by Rev. Ralph Kirby, former pastor of Calvary Baplist Church. <br />Minutes of the July 23, 1968 meeting were readand approved. <br /> <br /> The following reports from the City Manager were read: <br /> <br /> 68-260 - "I submit the attached ~rdi~a~e~and recommend it be placed on first reading. ~s apprepriates <br />$11,200 for the purchase of property at 112 Carolina Avenue. <br /> <br /> This purchase was agreed upon some time ago~ however, due to title problems, we have not been able to <br />complete the transaction. <br /> <br /> This property is due to be used in the development of the Marine Terminal." <br /> <br /> On motion of Mr. King, the following ordinance was approved on first reading, without dissenting vote; <br /> <br />"AN ORDINKNCE TO APPROPRIATE $11,200.00 FROM THE GBNE~RL CAPITAL IMPROVEMENT FUMD FOR THE PURCHASE OF <br />PROPERTY LOCATED AT t12 CAROLINA AVENUE, LOTS 18S THROUGH 188 IN PINNERS POINT.¥ <br /> <br /> 68-261 - "I submit the attached resolutiOn and recommend its adoption. It authorizes condemnation pro- <br />ceedings fOr three parcels of land needed for the Londeg-Glasgow Street expressway right-of-way. <br /> <br /> This action is necessary as we have not been able to agree on the price for one parcel and the other two <br />have title deficiencies." <br /> <br />On motion of Mr. Smith, the following resolution was adopted, without dissenting vote: <br /> <br />"A RESOLDTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH uNDER <br />EMINENT DOMAIN PROCEEDINGS PURSUANT TO Q{APTBR 229 OF ~ ACTs OF ASSEMBLY OF t9~6~ SAID PROPERTY <br />BEING NECESSARY FOR THE CONSTRUCTION, WIDENING AND IMPROVEMENT OF STATE HIGHWAY ROUTE S8 FROM THE <br />INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO THE INTERSECTION OF LONDON AND EFFINGHkM STREETS. <br /> <br /> ~%~EREAS, in cooperation with the Federal and State governments, State Highway Route 58 is being con- <br />structed, widened and improved from the intersection of Airlime Boulevard and High Street to the intersection <br />of London and Effinghan Streets in the City of Portsmouth, Virginia; and <br /> <br /> WItBREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision <br />of the land necessary for the construction; and <br /> <br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter specifie~ <br />in and to the hereinafter described parcels of land situate in the fiity of Portsmouth, Virginia, for the <br />purpose of constructing, widening and improving the aforesaid State Highway Route 58; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary <br />to the project, because the owners thereof and the City have not been able to agree upon the price to be paid <br />therefor, or tile City has not been able to locate certain of the owners or because of the status of the title <br />of certain parcels of the property; and <br /> <br /> WHEREAS, advancement of the work and use of said State High~ay Route 58 will be delayed unreasonably if <br />the said property is not made available as soon as possible. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special <br />counsel for that purpose if he deems it advisable, against the property hereinafter desc,ribed located <br />along State Highway Route 58, for the purpose of acquiring fee simple title therein, in accordance <br />with and pursuant to Section 25 (P) of the Charter of the City of Portsmouth (Chapter 229 of the Acts <br />of Assembly of 1966), and to deposit to the credit of the court as provided by law the sum hereinafter <br />specified to compDnsate the respective owners of the various parcels of land, as sho~rn on those <br />certain plans entitled Project 0058-124-102, R/W 201 and 202 dated February 14, 1966, sheet 15, a copy <br />of which is filed with the Department of Public Works of the City of Portsmouth, Virginia. <br /> <br /> PARCE,k NA~{E ~O~NT <br /> <br />122 C.E. This amends the Crawford Urban <br />Renewal Project regarding acquisition and land <br /> <br />These changes are as follows: <br /> <br />1. Parcel at the northwest corner of High and Miadle Stree~ is changed "Not ~e be Acquired"~ <br />2. Parcel at the northeast corner of Queen and Middle Street is changed "Not to be Acquired". <br />5. Parcel directly north of the above parcel changed to Commercial from designated Bank Parking. <br /> <br /> <br />
