We have not been able to reach an agreement on the price with the property owners involved." <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN gROPER%T BY ~ CITY OF PORTSMOU~{ UNDER <br />EMINENT DObbIN PROCEEDINGS PURSUAN~ TO CHAPTER 229~F ~{E ACTS OF ASSEMBLY OF 1966, SAID PROPER/Y <br />BEING NECESSARY FOR THE CONSTRU~ION, WIDENING ~D IMPROVEb~NT OF STATE HIGHWAY ROUTE S8 FROM THE <br />INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO THE INTERSECTION OF LONDON'AND EFFINGH~ STREETS~ <br /> <br /> ~tEREAS, in cooperation with the Federal and State governments, State Highway Route 58 is being constmucte~ <br />widened and improved from the intersection ~ Airline Boulevard and High Street to the intersection of London <br />and Effingham Streets in the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, one of the olbiations of the City of Portsmouth with respect to said project is the provision <br />of the land necessary, for the construction; and <br /> <br /> ~%~BREAS, the ~ity of Portsmouth has found it to be necessary to acquire the interest hereinafter specified <br />in and to the hereinafter described parcels of land situate in the City of Portsmouth, Virginia, for the pur- <br />pose of constructing, widening and improving the aforesaid State Highway Route 58; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary <br />to the project, because the owners thereof and the City have not been able to agree upon the price to be paid <br />therefor, or the City, hasher been able to locate certain of the owners or because of the status of the title <br />of certain parcels of the property; and <br /> <br /> ~tEREAS, advancement of the work and use of said State Highway Route 58 will he delayed unreason~ly if <br />the said property is not made available as soon as possible. <br /> <br />NOW, THEREFORH, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special <br />counsel for that purpose if he deems it advisable, against the property hereinafter described located along <br />State Highway Route 58, for the purpose of acquiring fee simple title therein, in accordance with alld ~l~suant <br />to Section 23 (F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly of 1966), and <br />to deposit to the credit of the court as provided by law the sum hereinafter specified to compensate the re- <br />spective owners of the various parcels of land, as shown on those certain plans entitled Project 0058-124-102, <br />R/W 201 and 202 dated February 14, 1966, sheet 14, a copy of which is filed with the Department of Publi~ <br />Works of the City of Portsmouth, Virginia. <br /> <br />PARCEL NAME A~)I~NT <br /> <br />098 <br /> <br />Robert C. The City Attorney is authorized to proceed against each individual oarcel and the resnective <br />owners ~hereof or against such combinations of parcels and the resoective owners thereof as he shall deem <br />advisable." <br /> <br />On motion of Mr. Smith, the foll~ing resolution ~as adopted, without dissenting vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY~BY TI{E CITY OF PORTS~iOUTH UNDER <br />EMINENT DO~AIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF TFLE ACTS OF ASSEMBLY OF 1966, SAID PROPERTY <br />BEING NECESSARY FOR THE CONSTRUCTION, WIDF~NING AND IMPROVE~iENT OF STATE HIGHWAY ROUTE S8 FROM TF~E <br />INTERSECTION OF AIRLINE BOULEVARD AND HIGH STP, BET TO THE INTERSECTION OF LONDON AND HFFINGHAM STREETS <br /> <br /> WHEREAS, in cooperation with the Federal and State governments, State Highway Route 5~ is being con- <br />structed, widened and improved from the intersection of Airline Boulevard and High Street to the intersection <br />of London and Effingham Streets in the City of Portsmouth, Virginia; and <br /> <br /> ~EREAS, part of the said highway has been designated as a Limited Access Highway in accordance with <br />the provisions of Article 3, Chaoter 1, Title 53, of the 1950 Code of Virginia as amended; and <br /> <br /> WF£REAS, one of the obligations of the City of Portsmouth with resoect to said project is the provision <br />of the land necessary for the construction; and <br /> <br /> %~{EREAS, the City of <br />in and to the hereinafter <br />of constructing, widening <br /> <br />Portsmouth has found it to be necessary to acquire the interest hereinafter specified <br />described parcel of land situate in the City of Portsmouth, Virginia, for the purpose <br />and improving the aforesaid State Highway Route 58; and <br /> <br /> LCHEREAS, the City of Portsmouth has not been able to purchase the property dgscribed herein, necessary to <br />the project~ because the owners thereof and the City have not been able to agree upon the price to be p~id <br />therefor, or:~the City has not been able to locate certain of the owners or because of the status of the title <br />of certain parcels of the property; and <br /> <br /> ~¢HEREAS, advancement of the work and use of said State Highway Route 58 will be delayed unreasonably if <br />the said property is not made available as soon as possible. <br /> <br /> Section 1. The City Attorney ~ directed to institute eminent domain proceedings, employing soecial couns~ <br />for that purpose if he deems it advisable, against the property hereinafter described located along-State High- <br />way Route 58 for the purpose of acquiring fee simple title tkerein~ together with any and all easements of <br />access, light, or air incident to the lands of the landowner abutting upon said Limited Access Highway and/or <br />upon any of its ramps~ loops, or connections at and with intersecting highways, in accordance with and pursuant <br />to Section 25(F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly of 1966) and to <br /> <br /> <br />
