<br /> At a Regular Meeting of the City Council on Tuesday, September 8,
<br />1998, the~e were present:
<br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C.
<br />Pitts, P. Ward Robinett, Jr., J. Thomas Benn III, William E. Moody, Jr.,
<br />Charles B. Whitehurst, Sr., City Manager Ronald W. Massie, City Attorney
<br />G. Timothy Oksman.
<br />
<br /> Councilman Whitehurst opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br /> Mayor Holley called the meeting to order and welcomed all in
<br />attendance.
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the
<br />minutes of a Called Meeting on August 11, 1998, a Regular Meeting on
<br />August 11, 1998, a Called Meeting on August 16, 1998, a Called Meeting on
<br />August 17, 1998, a Called Meeting on August 18, 1998, and a Called Meeting
<br />on August 25, 1998, and was adopted by unanimous vote.

<br />98-215 Presentations:
<br />
<br />· Presentation to the Portsmouth Library Board from Dunedin, New
<br /> Zealand.
<br />· Proclamation presented to Margaret Windley for "Constitution Week."
<br />
<br />. Public Hearing -
<br />
<br />98 -216 Public hearing on use permit applications:
<br />(a) UP.98-05 TRUXTUN NEIGHBORHOOD - Frances Curry requests a use
<br /> permit to operate a day care facility at 100 Noble Street
<br />
<br />1. Bernard Jones, 100 Noble Street, stated that the Board of Deacons and
<br /> Trustees of Noble Street Baptist Church would like tc withdraw the use
<br /> permit application t6 operate a day care facility.
<br /> Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to withdraw
<br /> Item 98-216 (UP-98-05), provided that Council receives a written request for
<br /> withdrawal from '{he owner of the property, within 48 hours.
<br /> Amended motion by Mr. Robinett, and seconded by Mr. Whitehurst, to
<br /> defer 98-216 (UP-98-05) until the September 22, 1998, meeting to give the
<br /> owner of the property adequate time to notify City officials of their intent to
<br /> withdraw, and was adopted by unanimous vote.
<br /> (b) UP-98-10 HIGHLANDS NEIGHBORHOOD - Brend~ Aston requests a use
<br /> permit to operate a day care facility at 3200 Victory Boulevard.
<br /> 1. Joseph Preziotti, Jr., 527 High Street, spoke in support of use permit.
<br /> Motion by Mr. Robinett, and seconded by Mr. Berm, to concur with
<br /> the recommendation of the Planning Commission and that UP-98-10 be
<br /> approved on first reading, and was adopted by 6-1 (Moody) vote.
<br />
<br /> · Mr. Robinett asked the City Manager to have staff review operation
<br /> hours for day care centers and compare with other cities.
<br />
<br />Mayor Holley questioned what criteria the Planning Commission
<br />reviews for day care centers and asked for a copy of the State
<br />guidelines.

<br /> Doran requests a use permit to operate a day care facility at
<br /> 1603 Highland Avenue.
