September 22. 1998 <br /> <br />City departments have assisted the Hoffler Creek Foundation from time to <br />time with various support activities such as assistance with surveying <br />activity and bulk waste material removal when such activities could be <br />accomplished within existing resources and operating requirements. It is <br />anticipated that similar activities will continue under the new lease. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the <br />following resolution, and was adopted by the following vote: <br /> <br /> "RESOLUTION AUTHORIZING A LONG-TERM LEASE AGREEMENT WITH <br />THE HOFFLER CREEK WILDLIFE FOUNDATION. <br /> <br /> WHEREAS the City has previously entered into a one-year lease with the <br />Hoffler Creek Wildlife Foundation (the "Foundation") for a 142-acre tract of <br />woodlands, wetlands, and a borrow pit (the "Property") located generally along <br />Twin Pines Road close to its intersection with River Shore Drive, with this lease <br />being for the purpose of developing a credible plan of action for the Property; <br />and <br /> <br /> WHEREAS the Foundation has, during the course of its lease with the <br />City, met all preliminary performance requirements of the City with regard to <br />funding and long-term planning, and the City has determined that it is in the <br />public interest to lease the Property to the Foundation for a longer, period of time <br />so that the Foundation can proceed with its master plan of developing the <br />property as a nature and wildlife preserve add/or conservation area open to the <br />public; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the City Manager is authorized, for and on behalf of <br />the City, to enter into an agreement with the Foundation substantially in <br />conformity with the attached "Long-Term Lease Agreement." The Manager is <br />further authorized to take such other actions as may be necessary to implement <br />said Agreement, subject to any legally required approvals of Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br />. NEW BUSINESS - <br /> <br />98 - 231 Boards and Commissions <br /> <br />There were no appointments. <br /> <br />Mr. Griffin stated that members of the Board of Zoning Appeals are <br />appointed by the Chief Judge of Portsmouth Circuit Court, and while the <br />City has been fortunate to have some very capable citizens appointed by <br />the Court to proVide this important public service, there is a need to have <br />alternate members appointed to the Board of Zoning Appeals to ensure <br />that there is always a quorum for scheduled Board of Zoning Appeals <br />meetings. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr, Benn, that the Chief Judge of <br /> Circuit Court be officially requested, on behalf of the City, to appoint three (3) <br /> alternate members to the Portsmouth Board of Zoning Appeals, and was <br />· adopted by unanimous vote. <br /> <br />98 - 232 Items Submitted by Council Members <br /> <br />Mr. Whitehurst stated that the Mayor has given his approval to be roasted on <br />October 23, 1998 by the Portsmouth Schools Foundation, at the Holiday Inn <br />at 6:30 p.m. Any remaining funds will go to the Portsmouth Schools <br />Foundation after expenses have been paid. <br /> <br /> <br />
