'1969 <br /> <br />On motion of Mr. Smith, the ordinance was adopted~ and by the folle~'ing vote: <br /> <br /> Ayes: Barnes, Nol.ley, Johnson, King, ~th, Turner <br /> Nays: None <br /> <br />- NEW BUSINESS <br /> <br />69-185 - The fOllowing letter from Charles L. Cain, High Constable, was read: <br /> <br /> "Due to the condition of my health I hereby tender my resignation as High Constable of the City of <br />Portsmouth. I request to be relieved of th~ duties of the office as of July 1, 1969. During the past several <br />months my deputy, Mr. James B. Early, ~.£no has been with me for twenty years, has carried on the work of the <br />office in a most satisfactory manner. <br /> <br /> The efficient conduct of the work of the High Constable is very important to the operation of the Civil <br />Division of the Mbmicipal Court, and to the litigants on both side of the case. The High Constable must ~ee <br />that the papers are properly served according to law so that a plaintiff may assert his claim and the defendant <br />is given an opportunity to defend the case. <br /> <br /> I wish to thank the members of the City Council, and those who have preceded you, and the officers and <br />employees of the 6ity for the any courtesies which they have shown to me. <br /> <br /> If the City Council. can see fit to award me a small pension it will be greatly appreciated. It appears <br />that I do not come under either the State retirement system or the social security." <br /> <br /> Motion of Mr. Smith to accept the resignatin with regret and that a resolution be prepared commending <br />· Mr. Cain for his services as High Constable, was adopted, without dissenting vote. <br /> <br />69-186 - The following letter from James B. Early was read: <br /> <br /> "Please accept this as my application for the position of High Constable of the City of Portsmouth for <br />the muexpired term of Mr. Charles L. Cain, the present Migh COnstable. <br /> <br /> Having been employed by Mr. Cain for the past 19½ year~:as Chief Deputy, I feel that I am qualified to fill <br />the position now being vacated. Any consideration given to me will certainly~-~ appreciated." <br /> <br />Motion of Mr. Ji~nson to refer to a conference was adopted, without dissenting vote. <br /> <br />69-187 - The following letter from the Director of Planning was read: <br /> <br /> "At its regular monthly meeting onJune S, 1969, the City Planning Commission resolved to endorse in <br />principle the document Five Year Capital Improvements. Program -A Plan for Community Growth, 1969-70 -'197S~74 <br />as presented by the City Manager during the May 6th monthly meeting and as amended by an errata-addenda sheet; <br />subject to two reservations. <br /> <br /> First, relative to Page 1-1, the planning Commission questions our ability to forego construction of a <br />new elementary school in Cavalier Manor in the coming five years in view of the recent decision to rec~fissify <br />80 acres of General Industrial M-2 property along the Norfolk and Western Railroad to Residential R-75; and <br />second, relative to Item 1-15, the Planning Commission questions our ability to embark upon this undertaking <br />in view of numerous decisions arrived at earlier in this decadeiwhich restricts land usage aro~n~ the Riddick- <br />Weaver Center. <br /> <br /> The Commission commends the City Manager, City Auditor, and all others who contributed to this pplendid <br />document and pledges its every effort to fulfillment of the goals embodied therein." <br /> <br /> MotiDn of Mr. Smith that the Planning Commission be commended for its recognition and support of the <br />Five Year Capital Improvement Pro,am, ~as adopted, without disSening vote. <br /> <br /> Motion of Mr. Smith to approve the Five Y~ar Capital Improvement Program was adopted, without dissenting <br />vote. : <br /> <br />69-188 - The following letter from the Director of Planning was read: <br /> <br /> "At its regular monthly meeting on June 3, 1969, the City Planning Commission resolved to recommend ~is- <br />posal of a lot measuring 81 feet by 257 feet which fronts on CraWford Parkway approximately opposite North <br />Street. <br /> <br />This land is designated on City Tax Plate 4 as Parcel 2.1. <br /> <br />A petition in this matter has been filed by Purl Powell on behalf of S. L. Nusbaum and Company." <br /> <br />Motion of Mr. Holley to ~e~er to a conference was adopted, without dissenting vote. <br /> <br />69-189 - The following letter from the Director of Planning was read: <br /> <br /> "At its regular monthly meeting on June 3, 1969, theft, grief Planning Com~nission resolved to reiterate its <br />May 6, 1969, position in recommending denial of commercial rezoning on the corner of Deep Creek Boulevard and <br />Greenwood Drive, cited below. <br /> <br /> The Commission senses no need for such spot zoning in this area and feels that unwarranted commercial deve- <br />lopment will adversely affect the surrounding residential neighborhood and undoubtedly contribute to traffic con' <br />gestion on this badly offset intersection wich may be difficult and costly to rectify. <br /> <br /> <br />
