September 25, 2001

Financial Impact:

· The real estate taxes for the current year are $754 and the property is assessed at
$53,120. The property was tax-exempt when it was used as a Synagogue. Under the
stewardship of the Friends of Chevra Thelim, the building will once again resume a
significant role in our community.

· Other than support for the return of the property to tax exempt status, the City has
had and will have no financial involvement in this special initiative. City staff has offered
encouragement and facilitative assistance to those individuals who have organized the
Friends group and would continue to do so under this proposed approach.

· Non-profit organizations owning property used exclusively for potentially tax exempt
purposes are not entitled to an automatic exemption for any property acquired
subsequent to July 1, 1971.

· The governing body of the locality must adopt a resolution with respect to any
request for tax exemption following a public hearing at which citizens have
opportunity to be heard.

an

· The resolution may only be adopted after the governing body considers the
questions posed in Section 30-19.04B of the Code of Virginia. (See Attachment.)

· If adopted, the resolution will be made available to a member of the Portsmouth
delegation for presentation to the General Assembly.

Motion by Mr. Whitehurst, and seconded by Mr. Griffin, to adopt the following
resolution, and was adopted by the following vote:

"A RESOLUTION SUPPORTING THE APPLICATION OF FRIENDS OF CHEVRA
THELIM, INC., FOR DESIGNATION AS A HISTORICAL AND CULTURAL
ORGANIZATION WITHIN THE CONTEXT OF SECTION 6 (a) (6) OF ARTICLE X OF
THE CONSTITUTION OF VIRGINIA.

WHEREAS, in accordance with Section 30-19.04 of the Code of Virginia, 1950,
as amended, the Council of the City of Portsmouth, Virginia held a Public Hearing on
Tuesday, September 25, 2001, after published notice in accordance with said Code
section, to consider the application filed on behalf of Friends of Chevra Thelim, Inc., for
exemption from taxes for real property located at 607 Effingham Street, Portsmouth,
Virginia, and used by the applicant exclusively for historical and cultural purposes on a
non-profit basis as set forth in Section 58.1-3650 of the Code of Virginia, 1950, as
amended; and

WHEREAS, the Council of the City of Portsmouth, Virginia has examined and
considered the provisions of Section 30-19.04 (B) of the Code of Virginia, 1950, as
amended, with respect to the petition of Friends of Chevra Thelim, Inc.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of
Portsmouth, Virginia, supports the request of Friends of Chevra Thelim, Inc., a non-
profit organization, for designation as a historical and cultural organization within the
context of Section 6 (a) (6) of Article X of the Constitution of Virginia and that its real
property located at 607 Effingham Street, in the City of Portsmouth, Virginia, owned by it
and used by it exclusively for historical and cultural purposes on a non-profit basis, be
determined to be exempt from taxation in accordance with Section 58.1-3650 et seq., of
the Code of Virginia, 1950, as amended.

BE IT FURTHER RESOLVED that the City Clerk be, and she hereby is, directed
to forward a copy of this resolution to each member of the Portsmouth delegation to the
General Assembly."

Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley
Nays: None
