<br />Financial Impact:
<br />
<br />· The real estate taxes for the current year are $754 and the property is assessed at
<br />$53,120. The property was tax-exempt when it was used as a Synagogue. Under the
<br />stewardship of the Friends of Chevra Thelim, the building will once again resume a
<br />significant role in our community.
<br />
<br />· Other than support for the return of the property to tax exempt status, the City has
<br />had and will have no financial involvement in this special initiative. City staff has offered
<br />encouragement and facilitative assistance to those individuals who have organized the
<br />Friends group and would continue to do so under this proposed approach.
<br />
<br />· Non-profit organizations owning property used exclusively for potentially tax exempt
<br />purposes are not entitled to an automatic exemption for any property acquired
<br />subsequent to July 1, 1971.
<br />
<br />· The governing body of the locality must adopt a resolution with respect to any
<br />request for tax exemption following a public hearing at which citizens have
<br />opportunity to be heard.

<br />· The resolution may only be adopted after the governing body considers the
<br />questions posed in Section 30-19.04B of the Code of Virginia. (See Attachment.)

<br />· If adopted, the resolution will be made available to a member of the Portsmouth
<br />delegation for presentation to the General Assembly.

<br /> Motion by Mr. Whitehurst, and seconded by Mr. Griffin, to adopt the following
<br />resolution, and was adopted by the following vote:
<br />
<br />"A RESOLUTION SUPPORTING THE APPLICATION OF FRIENDS OF CHEVRA
<br />THELIM, INC., FOR DESIGNATION AS A HISTORICAL AND CULTURAL
<br />ORGANIZATION WITHIN THE CONTEXT OF SECTION 6 (a) (6) OF ARTICLE X OF
<br />THE CONSTITUTION OF VIRGINIA.
<br />
<br /> WHEREAS, in accordance with Section 30-19.04 of the Code of Virginia, 1950,
<br />as amended, the Council of the City of Portsmouth, Virginia held a Public Hearing on
<br />Tuesday, September 25, 2001, after published notice in accordance with said Code
<br />section, to consider the application filed on behalf of Friends of Chevra Thelim, Inc., for
<br />exemption from taxes for real property located at 607 Effingham Street, Portsmouth,
<br />Virginia, and used by the applicant exclusively for historical and cultural purposes on a
<br />non-profit basis as set forth in Section 58.1-3650 of the Code of Virginia, 1950, as
<br />amended; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia has examined and
<br />considered the provisions of Section 30-19.04 (B) of the Code of Virginia, 1950, as
<br />amended, with respect to the petition of Friends of Chevra Thelim, Inc.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City of
<br />Portsmouth, Virginia, supports the request of Friends of Chevra Thelim, Inc., a non-
<br />profit organization, for designation as a historical and cultural organization within the
<br />context of Section 6 (a) (6) of Article X of the Constitution of Virginia and that its real
<br />property located at 607 Effingham Street, in the City of Portsmouth, Virginia, owned by it
<br />and used by it exclusively for historical and cultural purposes on a non-profit basis, be
<br />determined to be exempt from taxation in accordance with Section 58.1-3650 et seq., of
<br />the Code of Virginia, 1950, as amended.
<br />
<br /> BE IT FURTHER RESOLVED that the City Clerk be, and she hereby is, directed
<br />to forward a copy of this resolution to each member of the Portsmouth delegation to the
<br />General Assembly."
