They are 1620, 2504, 2508~ 2520 and 2524 ~ffmngnam ~vreev. <br />principally involves steps that must be removed from the right-of-way in order that the im- <br />provements to Effingham Street can be completed. <br /> It requires that the encroachment be removed by April 3~ 1970, and if not done, the <br />City will have the right to remove the encroachment and charge the cost as a tax against the <br />property.~ <br /> <br /> On motion of Mr. King~ the following resolution was adopted without dissenting vote: <br /> '~A RESOLUTION REQUIRING THE ~MOVAL OF CERTAIN ENCROACHMENTS FROM <br /> THE RIGHT OF WAY OF EFFINGHAM STREET. <br /> <br /> WHEF~AS, portions of buildings at 1620, 2504, 2508, 2520~ and 2524 Effingham Street <br />encroach on 6he right-of-way of the City of Portsmouth~ Virginia, and by such encroachment <br />hinder the widening a~d improvement of said Effingham Street~ and <br /> WHEREAS. George, David and Fannie White~ owners of 1620 Effingham Street~ Leonard J. Ki~ <br />owner of 250~ Effingham Street, James and Medetlia Mitchell~ o~ers of 2508 Effingham Street <br />L. Davis, owner of 2520 Effingham Street~ and Walter and Julia B. Fisher, owners of 2524 <br />Effingham Street have all been notified to clear said right-of-way a minimum distance of <br />four feet from the curb back of the widened Effingham Street and all such owners have not <br />cleared said right-of-way to such minimum distance. <br /> <br /> NOW~ THEP~FORE, BE IT RESOL~JED by the Co'~ncil of the City of Portsmouth~ Virginia, <br /> that pursuant to Section 15.1-893 of the Code of Virginia, i950~ as amended~ the aforesaid <br /> owners of the aforesaid properties are h~reby required to remove each such encroachment <br /> to a distance of four feet from the presently existing or proposed curb back of the wide~ed <br /> Effingham Street, on or before April 3~ 1970. <br /> <br /> BE IT FURTHER RJESOLVED, that if the aforesaid encroachments remain after April 3, 1970~ <br /> the responsible owner shall be fined five dollars for each and every day such encroachment <br /> remains after April 3~ 1970~ and the City Engineer shall cause such encroachment to be remow <br /> vhe cosz of such removal vo be charged againsv the subject property as a tax thereon.
