Kilgore was placed on <br />the agenda: <br /> Re: UP-69-8 (National Investors Corp.) <br /> "T~ Above-captioned use permit applicationhas been tabled by Council for several months pending dis- <br />position of the zoning application for property on the south side of Portsmouth Boulevard lying to the east of <br />City Park Avenue. Council at its ~gust meeting rezoned ~he subject property requiredpprior to consideration <br />of the subject use permi~ application for a gasoline service station to be located at the southeastern inter- <br />section of Portsmouth Boulevard and City Park Avenue. Accordingly, it is requested that this matter be con- <br />sidered by Council at its next Cot~cil meeting scheduled for September 8, 1970. The undersigned as attorney <br />for the applicant would like to be heard at this meeting to speak in favor of this application." <br /> <br /> ~otion of Mr. Sb~ith that the Council concur in the recommendation of the Planning Commission to deny <br />the request for the use permit for a gasoline station at the southeastern intersection of Portsmouth Boulevard <br />and City Park Avenue, was adopted mhd by the following vote: <br /> <br />Ayes: Johnson, King, Smith (R), Turner, Barnes <br />Nays: Holley <br /> <br />- NEiq BUSINESS - <br /> <br />70-589 - The following letter from !{ill!am E. Rachels, Jr. was read: <br /> <br />"Re: Tidewater ~olesale Grocery Company <br /> Portsmouth City License 1970-71 <br /> <br /> Reference 7msdmade to the June 2, 1970, letter of the undersigned addressed to the City Council of Ports- <br /> mouth and Hr. L. E. Turlington, Commissioner of Revenue, in ~egard to the above-referenced matter. Therein <br /> we stated that at such time as we were able to certify that Tidewater l~olasale Grocer/ Company had entirely <br /> ceased to do business within the City of Portsmouth, we would apply for a refund of the license tax paid under <br /> protest for that portion of the license year during which Tidewater }Fnolesalb Grovery Conrpany would not be <br />· transacting business within the City of Portsmouth. <br /> <br /> Pm Tidewater ~olesale Grocery Company can now make such certification, we request that we be placed <br />upon the docket of the City Council for its meeting scheduled for September 8, 1970, in order that we can appear <br />to request a refund of the license tax as aforesaid." <br /> <br />Motion of Mr. Turner to refer to the Tax Study Commission, was adopted and by the follm~ing vote: <br /> <br />Ayes: Johnson, King, Smith (R), Turner, Barnes <br />Nays: Holley <br /> <br />70-390 - ~he following letter from ~rs. Marcia T. Bauer was read: <br /> <br /> "It is respectfully requested that a member of our organization, the Churchland Interfaith 7~ouncil, be <br />permitted to address the City Council on September 25, 1970. <br /> <br />This is in regard to an open ditch in the Herr!field-Twin Pines area which presents a ~azard to residents." <br /> <br />M.
