<br />At a regular meeting of the City Council, held on September 29, 1970, there were present:

<br />Jack P. Barnes, Burrell R. Johnson, Isaac W. King, R. Irvine Smith, Raymond B. Smith, Raymond Turner,
<br />A. P. Johnson, Jr., City Manager and M. A. Korb, Jr., City Attorney.

<br />The meeting was opened with prayer by Dr. T. J. Powers.
<br />
<br />70-599 - The following public hearing on zoning and use permits was held:
<br />
<br />Petition Z 70-10 - William L. Ward by Attorney Donald C. Kilgore
<br />
<br /> No one spoke regarding the application.
<br />
<br /> M~tion of Mr. King to place the following ordinance on first reading was adopted, and by the following

<br />Use Permit 70-15 - Application of T. B. Lee, Inc.

<br /> On motion of Mr. Turner, the following resolution was adopted, conting~m~!:apon the ability 6~ Mrs. Mattie
<br />Williams, contract owner, to secure a state license for the use, and by the following vote:
<br />
<br />"A RESOLUTION GRANTING A USE PEPa%~IT FOR THE OPERATION OF A HO~IE FOR THE AGED AT THE
<br />CORNER OF RANDOLPH STP. BET ;OID SIXTH STREET
<br />
<br /> WHEREAS, T. B. Lee, Incorporated has made application pursuant to Section 4-2 of the Zoning Ordinance
<br />of .the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done in connection
<br />with said application, and the Planning Commission has recommended the granting of said use permit, subject
<br />to the conditions hereinafter stated.
<br />
<br />NOW, THEREFORHi, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />That the use for which the use permit hereinafter described is sought (1) will not adversely affect
<br />the health or safety of persons residing or working in the neighborhood of the proposed use, (2) will
<br />not be detrimental to the public welfare or injurious to property or improvements in the neighborhood,
<br />and (5) will be in accord with the purposes of said Zoning Ordinance.
<br />
<br />That T. B. Lee, Incorporated is hereby granted a use permit subject to site plan restrictions, and
<br />conditioned upon the granting of the appropriate license required for subject home under Section
<br />65.1-175 of the Code of Virginia, 1950, as amended, pursuant to Section 4-2 of said Zoning Ordinance
<br />for the operation of a Home for The Aged located on the property described as follows:
<br />
<br />Beginning at a point on the southeast intersectiDn of Randolph Street and Sixth Street; thence runnin
<br />easterly along the southeast right-of-way line of Randolph Street 82 feet, more or less, to a point;
<br />thence running southerly 155 feet, more or less, to a point; thence running westerly 82 feet, more
<br />or less, to a point on the eastern right-of-way line of Sixth Street; thence running northerly along
<br />said easterly right-of-way line of Sixth Street 155 feet, more or less, to the point of beginning."

<br />Use Permit 70-16 - Application of Kittrell's Floor Service, Inc.
<br />
<br />J. S. Livesay, Attorney, Chester H. McKibber and Oscar Irby spoke and presented the following petition:
<br />
<br /> "We desire this petition bearing 79 signatures to be entered in the records of this hearing expressing
<br />opposition to the issuance of a use permit to operate a mobile home park in the vicinity of Bide-A-Wee
<br />Manor, said proposed park bordering the south side of the rear lot lines on the South Side of McLean Street.
<br />Signed by Charles E. Proffit, 655 McLean Street, and others"

<br />Motion of Mr. Johnson that the petition be denied was adopted and by the following vote:
