<br /> At a regular meeting of the City Council held on November 24, 1970. there were present:
<br /> James W. Holley, Burrell R. Johnson,. Isaac ~,. King, R. Irvine Smith, Raymond B. Smith, Raymond Turner,
<br /> Jack P. Barnes, A. P. Johnson, Jr., City ~anager, 2!. A. Korb, Jr., City Attorney.

<br /> The meeting was opened with prayer by Mr. King.
<br />
<br /> 70-512 - The following public hearing on zoning and use permits was held:
<br /> Zoning Petition Z 70-18 - Southland Corporation and Albano Cleaners
<br /> Donald Kilgo~e, Attorney, spoke.
<br />
<br /> On motion of Mr. Smith (I), the following ordinance was approved on first re~ading, and by the following
<br />vote:
<br />
<br /> "ZONING ;~ND.~NT ORDINLNCE Z 70-18"
<br />
<br /> Ayes: Holley, Johnson, King, Smith (I), Smith [R), Turner, Barnes

<br />

<br /> On motion of 5!r. Smith (.R) the following resolution was adppted and by the following vote:

<br /> "A R~SOLUTION GR~NTING A USE PERMIT FOR THE OPERATION OF AN AUTOMOTIVE SERVICE STATION WEST
<br /> OF THE SOUq]-{~ST CORNER OF HICk{ STREET WEST ~ND TYRE NECK ROAD
<br />
<br /> }~HERE~S, Harold and Irvin Eisenberg, T/A Valu-Fair Stores have made an application pursuant to Section
<br /> 4-2 of the Zoning Qrdinance of the City of PorSsmouth, 1961, for the granting~ of a use permit as hereinafter
<br /> described; and
<br />
<br /> }CqEREAS, the applicant and the Planning Director have done all things required to be done in connection
<br />with said application, and the Planning Commkission has recommended the granting of said use permit, subject
<br />to the condtions hereinafter stated.
<br />
<br /> NOW, ~tEREFORE, BE IT RESOL~ED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> A. That the use for which the use permit hereinafter described is sought (1) will not adversely aff~c~t
<br /> the health or safety of ~ersons residing or working in the neighborhood of the proposed use,
<br /> will not be detrimental to the public welfare or injurious to property or improvements in the
<br /> neighborhood, and ($) will be in accord with the purposes of said Zoning Ordinance.
<br />
<br /> B. That Harold and Irvin Eisenberg are hereby granted a use permit~ subject to site plan restrictions,
<br /> pursuant to Section 4-2 of said Zoning Ordinance~ for the operation of an automotive service station
<br /> located on the property described as follows:
<br />
<br /> Beginning at a point on the ~outhern right-of-way line of High Street West 150 feet, more or
<br /> less West of the Southwest intersection of High Street West and Tyre Neck Road; thence running
<br />
