<br />"A RESOLUTION GRANTING A USE PERMIT TO OPERATE A JUNK YARD WEST OF
<br />IDA BARBOUR HOMES.
<br />
<br /> WHEREAS, Curtis Coan has made an application pursuant to Section 42 of the Zoning
<br />Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter
<br />described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to
<br />be done in connection with said application, and the Planning Commission has recommended
<br />the granting of said use permit, subject to the conditions hereinafter stated.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA:
<br />
<br /> A. That the use for which the use permit :hereinafter described is sought (1) will
<br />not adversely affect the health or safety of persons residing or working in the neighborhood
<br />of the proposed use, (2) will not be detrimental to the public welfare or injurious to
<br />property or improvements in the neighborhood, and (5) will be in accord with the purposes
<br />of said Zoning Ordinance.
<br />
<br /> B. That Curtis Coan is hereby granted a use permit to operate a junk yard subject
<br />to the following conditions:
<br />
<br />{1)
<br />
<br />That the portion of Rutter Street presently extending
<br />right-of -way line of Peninsula Avenue (paper street)
<br />fence line of Curtis Coan Metal Co. be' closed,
<br />
<br />from the western
<br />to the western
<br />
<br />(2)
<br />
<br />That open burning as prohibited by Section 4~41{b) of the Zoning Ordinance
<br />of the City of Portsmouth and Rule 4.1 of the Rules of the State Air
<br />Pollution Control Board not be conducted, and
<br />
<br />(3) That the area described below be ~ermanently enclosed by a

<br />pursuant to Section 4~2 of said Zoning Ordinance on the property described as follows:

<br />Beginning at a point on the western right-of-way line of Peninsula Avenue
<br />(paper street) at its southern terminus; thence running northerly along said
<br />western right-of-way line of Peninsula Avenue 350 feet, more or less, to a
<br />point on the intersection of said western right-of~way line and the south-
<br />eastern right-of-way line of the 'Seaboard Coast Line Railroad; thence running
<br />southwesterly along said southeastern right-of-way line of said railroad 450
<br />feet, more or less, to a point on the intersection of said southeastern
<br />right-of-way line of said railroad and the northeastern right-of-way line
<br />of another track line of said Seaboard Coast Line Railroad; thence running
<br />southeasterly along said northeastern right-of-way line of said railroad
<br />400 feet, more or less, to the point of beginning.
<br />
<br /> C. That this use permit is subject to review, revision and amendment at the discretion
<br />of the City Council at any time after two years from the date hereof and every two years
<br />thereafter for as long as this use permit shall remain in force. This use permit is also
<br />subject to revocation or any other appropriate legal remedy at any time for the failure
<br />of the permittee to comply with the provisions and conditions hereinabove stated."
