<br />Section 2. The full faith and credit of the City of Portsmouth shall be pledged
<br />to the payment of the principal of and interest on the Bonds as the same become due. For
<br />the payment of such principal and interest, the City of Portsmouth shall have power and
<br />be obligated to levy ad valorem taxes without limitation as to rate or amount on all the
<br />property subject to taxation by the City.
<br />
<br />Section 3, Full power and authority is hereby given to the City Manager of the City of
<br />Portsmouth to prepare and issue the Bonds in such form and for such sum as is authorized
<br />by Section 1 hereof. The City Manager is authorized to cause to be imprinted on the back
<br />of each of the Bonds, a copy of the complete final legal opinion with respect to the Bonds,
<br />with the name of the attorney or attorneys rendering same, together with a certification
<br />of the City Clerk evidenced by a facsimile signature of that officer, to the effect that
<br />the copy is a true and correct copy of the legal opinion which was dated as of the date
<br />of delivery of and payment for the Bonds. Full power and authority is hereby given the City
<br />Manager to sell said bonds in such manner, either at public or private sale, and at such
<br />time and place, as thelCity blanager may determine; provided, however, that no sale shall
<br />be made without the approval of the City Council.

<br />Section 4'rtThee Bonds I hall not be subject to taxation by the City of Portsmouth, and the
<br /> p aining to paid Bonds, shall after the maturity of said coupons, be received in
<br />paymentcoupons of all dues, t~xes, and assessments due to the City.

<br />Section 5. Ail resolutions or orders, or parts thereof, in conflict with the provisions
<br />of .this resolution, are to the extent of such conflict hereby repealed.

<br />Section 6. This resolution shal.1 take effect from its passage."

<br /> 71-49 - "At the last meeking of the City Council, I was requested to submit a report
<br />concerning the legal and financial status of the Law Library. For the information of the
<br />Council there is attached hereto a copy of Section 42.170 of the Virginia Code which allows
<br />cities to make assessments for a law library as part of costs in civil actions. There is
<br />also attached a copy of the Portsmouth City Code, Article XV, pertaining to the law library
<br />fund.

<br /> The Virginia Code states that these funds are to be used "for the acquisition of law
<br />books and law periodicals for the establishment, use and maintenance of a law library which
<br />shall be open for the use of the public. In addition to the acquisition of law books and
<br />law periodicals, the disbursements may include compensation to be paid to librarians and
<br />other necessary staff for the maintenance of such library and acquisition of suitable quarte
<br />for such library." The City Code provides the same stipulations as well as providing for
<br />the establishment of a special fund.

<br /> There is also attached hereto a financial statement as to the status of the law libraryl
<br />funds as of January 31, 1971. Expenditure.s for the current fiscal year through January $1,
<br />1971, have amounted to $11,303.20. This has been abnormally high due to the purchase of
<br />equipment and furniture for the library's new location in the Civic Center. It is estimated
<br />that it will take approximately $4,800 to finance the operation of this library to the end
<br />of the fiscal year. The cash balance in this fund as of January 31, 1.~71, was $25,718.87."

<br /> Mr. Irvine Smith asked that Mr. Kor, City Attorney, make an inquiry as
<br />Law Library Fund could be used for such thinga as the purchase of law books

<br /> 71-50 "At a previous Council meeting, I was instructed to investigate and report on
<br />the possibility of our Fire Department recharging fire extinguishers for the citizens and
<br />private business establishments of the City, making appropriate charges for this service.
<br />The following report is submitted for your consideration.
<br />
<br /> We now provide and have provided for several years service of this type on a very limit~
<br />basis and confined to service on 2-1/2 gallon soda and ash extinguishers, 2-1/2 gallon foam
<br />extinguishers, and 2-1/2 gallon stored pressure water-expellant extinguishers (prbvided the
<br />expellant force is compressed air, capable of being applied through use of a normal air comp
<br />presser.) Replacement parts and chemicals necessary for recharging these extinguishers are
<br />purchased through the operating budget of the Fire Department. A nominal charge slightly
<br />in excess of cost of materials is made to citizens and business establishments who avail
