Feb~m~t.z 23. 1971 <br /> <br />71-43 - The following ordinance, approved on first reading at last meeting was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $7,964.65 FROM THE GENERAL FdND AS THE CITY'S CONTRIBUTION <br />TO THE SOUTHEASTERN TIDEWATER OPPORTUNITY PROJECT." <br /> <br />On motion of Mr. Turner, the ordinance was adopted, and by the following vote: <br /> <br />AMe~:y Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />71-44 - The following ordinance, approved on first reading at last meeting was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $600,000.00 FROM TNE UTILITY FUND FOR THE CONSTRUCTION OF <br />ALTERATIONS AND ADDITIONS TO THE WATER FILTER PLANT." <br /> <br />On motion of Mr. Irvine Smith, the ordinance was adopted, and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />71-45 - The following ordinance, approved on first reading at last meeting was taken up and read: <br /> <br />"AN ORDINANCE TO A~ND SECTIONS 10-128 AND 10-129 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1961, PERTAINING TO MEMBERSHIP OF THE PORTSMOUTH TAX STUDY COMMISSION." <br /> <br />On motion of Mr. Raymond Smith, the ordinance was adopted, and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />71-46 - The following ordinance, approved on first reading at last meeting was taken up and read: <br /> <br />"AN ORDINANCE TO CLOSE A PORTION OF CAMBRIDGE AVENDE." <br /> <br />On motion of Mr. Raymond Smith, the ordinance was adopted, and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />71-47 - The following ordinance, approved on first reading at last meeting was taken up and read: <br /> <br />"AN ORDINANCE FOR CLOSING PORTIONS OF CUTOFF AVENUE, JACKSON AVENUE AND LAIGH ROAD <br />IN WASMINGTON HEIGHTS." <br /> <br />On motion of Mr. Turner, the ordinance was adopted, and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />~: '7t,49 ~'The::fe!~6W~ng report from the City Attorney was read: <br /> <br /> "In accordance with your request I have looked into the matter of the collection and use of Law Library <br />fees. <br /> <br /> According to information which has been fdrnished to me by the clerks of the various courts the following <br />amounts were collected by each respective court during the fiscal year 1969-1970: <br /> <br />Circuit Court <br />Court of Hustings <br />Municipal Court, Civ. Div. <br /> <br />Law Library Fees <br />$ 998.90 <br /> 653.00 <br /> 8,377.50 <br /> <br />Total $ I0,028.50 <br /> <br /> The State enabling legislation and the City ordinance adopted thereunder provides that such funds may be <br />used to purchase law books and periodicals, for s~laries of librarians and othe~ staff members and for the main- <br />tenance and acquisition of suitable quarters for such a Public Law Library. Therefore, in my opinion it would <br />be legal to charge a reasonable rental fee to the Law Library for the use of the space in the Civic Center." <br /> <br />On motion of Mr. Johnson, the report was YeceiPed as information, without ~issenting vote. <br /> <br /> On motion of Mr. Johnson, that the City Manager research the legality of charging rent for court space <br />used by courts and for their purchase of law books, was adopted, without dissenting vote. <br /> <br />71-59 - (See.first order of business) <br /> <br />- NE~'BUSINESS - <br /> <br /> 71-75 - The following letter was received from Benjamin J. Levy., Attorney, representing Robert L. Ewell: <br /> <br /> '~te represent Mr. Robert L. Ewell, of Bob Ewell Tire ServiCe, Inc., whose business is located at 705 <br />Constitution Avenue in the City of Portsmouth, Virginia. At the present time, the 700 block of Constitution <br />Avenue (from County Street to Columbia Stree) is one-way. ~4r. Ewell has requested us to write to ask that this <br />block of Constitution be made two-way, in order to allow customers to enter and leave his establishment. <br /> <br /> <br />
