<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY
<br />THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS
<br />PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY OF,1970, SAID PROPERTY
<br />BEING NECESSARY FOR THE CONSTRUCTION OF A PARK TO BE LOCATED BETWEEN
<br />FAYETTE AND SIXTH STREETS IN THE CITY OF PORTSMOUTH.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest herein-
<br />after specified in and to the hereinafter described parcel of land situate in the City of
<br />Portsmouth, Virginia, for the purpose of constructing a neighborhood park; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein, necessary to the project, because'the owners thereof and the City have not been abl~
<br />to agree upon the price to be paid therefor, or the City has not been able to locate certair
<br />of the owners or because of the status of the title of the property; and
<br />
<br /> WHEREAS, advancement of the work and use of said project will be delayed unreasonably
<br />if the said property is not made available assoon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. The City a~torney is directed to institute eminent domain proceedings, employing
<br />special counsel for that purpose if he deems it advisable, against the following property
<br />situate in the City of Portsmouth, for the purpose of acquiring fee simple title therein,
<br />together with any and all easements of access, light or air incident to the lands of the
<br />landowner abutting upon said property, in accordance with and pursuant to Sections 2.06,
<br />2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 47i of the Acts of Assembly
<br />of 1970), and to deposit to the credit of the court as provided by /aw the sum hereafter
<br />specified to compensate William J. Wright and Marie E. Wright, the owners of the hereinafte
<br />described property.

<br />2, The property to be acquired hereUnder is described as:
<br />
<br />All that certain lot of land with its appurtenances, situate in the
<br />City of Portsmouth, Virginia, and bounded and described as follows,
<br />towit'
<br />
<br />Beginning at the southwest inter-
<br />section of Sixth and Fayette Streets, and from thence running
<br />south along Sixth Street thirtyseven (57) feet; thence west
<br />and parallel with Fayette Street sixty (60) feet; thence
<br />north thirtyseven (57) feet to Fayette Street; and thence east
<br />along Fayette Street sixty (60) feet to the point of beginning.

<br />$. The amount of money to be deposited with 'the court is $550.00."

<br /> 71~69 -'"I submit the attached agreements between the Virginia Electric and Power Compa
<br />and the City of PortsmOuth and recommend that the proper City.officials be authorized to
<br />sign. These agreements cover electrical service for City-owned facilities.
<br />
<br /> One agreement is for electrical service to be furnished the recreation park being
<br />developed on the Obici property in Nansemond County. The other agreement covers underground
<br />electrical service to the new Health Center at the corner of Effingham Street and Crawford
<br />Parkway."

<br /> On motion of Mr. King, to recommend that the proper City Official be authorized to
<br />sign an agreement between VEPCo and the City of Fortsmouth, was adopted, without dissenting
<br />vote·
<br />
<br /> 71-70 -"As requested at the last me~ting of City Council, I submit herewith a letter
<br />and statistical report received from Southeastern Tidewater Opportunity Project. This
<br />lists the various programs in 6peration in the City of Portsmouth. This also shows the
<br />amount of federal funds received along with local in-kind services that are provided.U
<br />
<br /> On motion of Mr. Irvine Smith, a statistical report by the City Manager as~submitted
<br />by the Southeastern Tidewater Opportunity Project, was received as information, without
<br />dissenting vote.
<br />
<br /> Mr. Hoiley ask that a percentage of total benefit persons employed, and monies be
<br />made available by STOp to Portsmouth City Council.
<br />
<br /> 71-71 "I submit the attached deed and recommend that the proper City officials be
<br />authorized to sign. Mr. and Mrs Harry L. Boon~ purchased property in the Hattonsville
<br />area of the City adjacent to land owned by the City of Portsmouth. There has been some
<br />question as to the property line between the land purchased and that owned by the City.
<br />The~execution of this deed will clarify this matter by properly establishing the boundary
<br />line between the two properties. This has been approved by the City Attorney."

<br /> On motion of Mr. Holley, to concur with the CityManager's recommendation that proper
<br />Cityi~,Officials be authorized to sign, was adopted, without dissenting vote·
