71-104 - "At the last City Council meeting, you gentlemen referred to the City Attorney
for a legal opinion a letter from the Chairman of the Parks and Recreation Commission request-
lng that said Commission be designated as the appropriate body to name park areas and facili-
ties.

It is my opinion that the Parks and Recreation Commission is already empowered to name
such areas and facilities under authority of Section 2-71.1 of the Code of the City of
Portsmouth 1961. Such section sets forth the powers and duties of the Parks and Recreation
Commission. It should be pointed out, however, that such power to name park areas and facili-
ties is, of course, subject to review by the City Council. Such review is granted under
authority of Section 2-71.5 of the Code of the City of Portsmouth, 1961 wherein it says:
"All actions of the Park and Recreation Commission shall be subject to review by the City
Council which may take such action thereon as it deems advisable."

On motion of Mr. Irvine Smith, an opinion rendered by Mr. W. J. O'Brien, Jr., Assistant
City Attorney, relating to the Parks and Recreation Commission requesting that said Commission
be designated as the appropriate body to name park areas and facilities, was received as in-
formation, with a copy of the letter to be sent to the Chairman of Parks and Recreation,
was adopted by the following vote:
C~urt and Associate Judge of the Municipal Court, Civil Division, at the end of this month,
efficient way xn which he has always striven to aid

"Will you please vote against letting a real estate office move into the property
located at King Street and Caroline Avenue in Westhaven?

We do not want that business nor any other business located in our area. It's also too
congested on that corner for a business."

On motion of Mr. Irvine Smith, the letter was referred to the meeting of Public Hearing,
April 12, 1971, by the following vote:
was read:

"Last June, I presented a petition to the City Council, asking that the 4300 and 4400
blocks of Columbia Street in Westhaven be curbed and guttered. It was signed by the property
owners on these blocks.

These signers have continually asked me when this will be done, and now that our property
has a newly assessed value, making our real estate taxes higher, we feel more than ever that
we should have this done.

All of the property owners on these blocks will appreciate it very much, if you will
give this matter your earliest attention."
