Many of these <br />vehicles which have been parked in front of junkyards in this area were on City property -- <br />others on property of the owners. The Chief of Police was instructed to contact the owners <br />of businesses in this area and to instruct them that all vehicles must be moved from City <br />property immediately. Operators here were to be informed that they would not be permitted <br />to park vehicles on City property or conduct any part of their business thereon. Persons <br />contacted by the Police were very cooperative and within a few days all such vehicles had <br />been removed from City property. <br /> <br /> Each of the yards mentioned have used-car dealers' licenses which permits them to have <br />vehicles in running condition parked in front of their places of business, on their property. <br />This is still an unsightly and undesirable sight along one of the main entrances into the <br />City of Portsmouth. <br /> <br /> Mr. Trant, Director of Inspections, was instructed to have investigated the use permits <br />for the junkyards operating along Turnpike Road. This investigation revealed that one <br />operator is now in the process of having a fence installed around his operation to conform <br />with the terms set forth in his use permit. Other operators mn this area were informed that <br />if the provisions of their use permits are not complied with, the City will revoke such use <br />permits. All operators promised to begin working on the requirements so that their use per- <br />mits would not be revoked. <br /> <br /> In our opinion, the operators in this area plan to comply with their use permit pro- <br />visions and, if so, this unsatisfactory situation will be cleared up. We plan to keep close <br />check on this matter and should the owners not live up to their promises, we will take <br />necessary steps to revoke use permits." <br /> <br />Motion of Mr. Johnson, to accept the report of the City Manager. <br /> <br /> A substitute motion of Mr. Irvine Smith, to refer the matter back to the City Manager <br />for additional consideration and investigation, was adopted, and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 71-144 "At the last Council meeting on March 23, I was instructed to investigate the <br />matter of a building permit being issued to the First Baptist Church of Taylorsville located <br />on Turnpike Road since offstreet parking area for use with this church was questionable. <br />On April 8, 1968, a variance was granted by the Board of Zoning Appeals to the church, grant- <br />ing a waiver of the building setback lines. This church was relocated to enable the School <br />Board to acquire land in front of S. H. Clarke Junior High School. The minutes of the <br />meeting of the Board of Zoning Appeals concerning this application read as follows: <br /> <br />'The Board next heard the application of First Baptist Church of Taylorsville <br />for waiver of front area and setback and side and rear yard requirements for <br />construction of a church at 2720 Turnpike Road. Inasmuch as the church was <br />moving to the new site partly as an accommodation to the Portsmouth City School <br />Board and the new structure was felt to be a potential help in renewing a some- <br />what run-down neighborhood and further that to attempt strict compliance with <br />the ordinance would work a hardship on the congregation, the Board granted the <br />requested variation with the express condition that the front setback be 15.5 <br />feet vs. the 10~5 feet requested and that rear yard requirement be thereby <br />reduced to 1 foot.' <br /> <br /> Waivers were granted for yard setback and plot coverage, parking is provided across <br />Turnpike Road on land owned by the Portsmouth School Board by letter of agreement from the <br />School Board to the First Baptist Church of Taylorsville. The School Board was interested <br />in qcquiring the property that is presently owned by the Church; therefore, in order to <br />expdite this acquisition, this permit was issued. <br /> <br /> The School Board, although interested in buying the property on which the old church, <br />stood at the time that the permit was issued, apparently has changed their plans and may not <br />require this property. When the new building is completed and the present demolished, there <br />will be sufficient area to provide necessary parking for this establishment." <br /> <br /> Motion of Mr. Johnson, to receive the report as information. The motion further stated <br />that the City Attorney advise the Board of Zoning Appeals of the legality of granting <br />variances in such matter as waivers of the building setback lines, was adopted, and by the <br />following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> <br />
