April 27, 1971 <br /> <br />At a regular meeting of the City Council, .held on April 27, 1971, there were present: <br /> <br />Jack P.' Barnes, James W. Holley, Burrell R. Johnson, Isaac W. King, R. Irvine Smith, <br />Raymond B. Smith, Raymond Turner, A. P. Johnson,Jr., City Manager, and M. A. Kerb, Jr., <br />City Attorney. <br /> <br />The meeting was opened with prayer by Mr, King. <br /> <br /> Mr. T. E. Masters, Jr., City Clerk being absent, the minutes of the Public Hearing <br />meeting of April 12, 1971 and minutes of regular Council meeting of April 1S, 1971, were <br />read by Mr. H. M. Myers, Jr., Assistant to City Manager. <br /> <br />The following reports from~the City Manager were read: <br /> <br /> 71-170 "I submit the attached ordinance and recommend it be placed on first reading. <br />This adds a new section to the City Code requiring merchants to post signs concerning <br />the prohibition against concealment of merchandise. <br /> <br /> This requires every merchant to post in a conspicuous place for the general public <br />a sign setting forth the provisions of the Code pertaining to the concealment law. This is <br />being required in order that the public can be made aware of the concealment law and prevent <br />unintentional violations which can lead to being arrested." <br /> <br /> On motion of Mr. Turner the following ordinance was approved on first reading, and by <br />the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />BY ADDING THERETO A NEW SECTION NUMBERED 19-1S.2, REQUiIRING MERCHANTS TO <br />POST SIGNS, CONCERNING THE PROHIBITION AGAINST CONCEALMENT OF MERCHANDISE." <br /> <br />Ayes: <br />Nays: <br /> <br />Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />None <br /> <br /> 71-171 "I submit the attached ordinance and recommend it be placed on first reading. <br />This amends the ordinance recently adopted pertaining to swimming pools. It removes hotels <br />and motels from a requirement of this ordinance since they are under State inspections which <br />are more stringent than the requirements of this ordinance. <br /> <br /> This also amends technical requirements that were in the original ordinance which were <br />impractical." <br /> <br /> On motion of Mr. Johnson the following ordinance was approved on first reading, and by <br />the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITYJOF PORTSMOUTH, VIRGINIA, 1961, <br />BY AMENDING SECTIONS 14-14, 14-17, 14-19, 14-21, 14-24, 14-2S AND 14-26 <br />THEREOF A NEW ARTICLE, PERTAINING TO THE CONSTRUCTION, OPERATION AND MAIN- <br />TENANCE OF SWIMMING POOLS." <br /> <br />Ayes: Johnson, King, Raymond Smith, Turner, Barnes <br />Nays: Holley, Irvine Smith <br /> <br /> 71-172 "I submit the attached ordinance and recommend it be placed on first reading. <br />This amends the City Code pertaining to service retirement and creditable service in the Ports <br />mouth Supplemental Retirement System, and the Portsmouth Fire and Police Retirement System. <br /> <br /> This provides that any person who was formerly a member of the Supplemental Retirement <br />System and ceased to be a member by withdrawing his contributions to become a member of %he <br />Virginia Supplemental Retirement System can be restored to membership. The employee can do <br />this by having'continuous service with the City in a combined City and State office, and if <br />he repays to the system the amount of contributions he has withdrawn. This provision pro- <br />vides for employees in the Commissioner Of Revenue's office who were declared ineligible for <br />prior City service in the Virginia Supplemental Retirement System to receive credit for their <br />years of service with the City for which they ar~ presently not eligible. <br /> <br /> This also provides for a person who was formerly a member of the Virginia Supplemental <br />Retirement System creditable service under the Portsmouth Supplemental Retirement System, <br />provided he pays into the system the amount of contributions he withdrew from the State system <br />This must also be continuous service with the City. <br /> <br /> Under the Fire and Police Retirement System, it provides creditable service for an employ <br />who was a paid full-time employee of a county or city police or fire department, provided <br />he was a resident of an area annexed and transferred directly from such county or city depart- <br />ment to the Portsmouth department between the time of the final annexation decree was entered. <br />This further provides that the employee must pay into the system a sum equal to the amount <br />he would have contributed for the years of creditable service granted. <br /> <br /> There is also a provision amending the early retirement in the present ordinance from <br />age 60 to age 55. This is recommended since the compulsory-retirement age for City employees <br />has been reduced from age 70 to age 6S. This will have no financial effect on the retirement <br />system, as the employees' retirement benefits are reduced in ratio to the number of years <br />of early retirement taken.', <br /> <br /> <br />
