- UNFINISHED BUSINESS <br /> <br /> 71-270 USE PERMIT 71-4 Petition of Southern Fuel Distributors, Inc. <br /> The following letter received from Mr. J. Brewer Moore, Director of City Planning, was <br />read: <br /> <br /> "At its regular monthly conference on July 20, 1971, the City Planning Commission dis- <br />cussed the matter of including regulations in Use Permits for automotive service stations. <br />R~tevancy~of~such m~vi~w~withpu~B, m2abi~i%yitoUsug~es~mean~ng~ut©~egulati~s tailored to <br />each specific case is questioned by the Commission which has been made aware of certain <br />possible legal-enforcement problems. The Commission ~lso reflected n what other communities <br />across the country are attempting to accomplish in concert with trade associations such as <br />the Petroleum Institute representing major oil companies. Everyone seems to be in favor of <br />reasonable and meaningful regulations for automotive service stations, but no one has come <br />up with an acceptable first step in this direction. <br /> <br /> The Commission feels that a go~d place to start in Portsmouth is in our new "TRUXTUN <br />CODES ENFORCEMENT AREA" where the site of UP-71-4 is located. The Commission feels that the <br />City Council should include in its Use Permit as many suggestions as are agreed upon between <br />the applicant and the municipality. The Commission pledges that if this course of action is <br />followed, it will research the matter, keep in touch with the applicant and report back to <br /> <br />City Council on problems growing out of this approach. <br />his interest in reasonable regulations and his support <br />Commission sees no reason not to innovate." <br /> <br /> On motion of Mr. Raymond Smith and seconded by Mr. <br />adopted, as amended, by the following vote: <br /> <br />"A RESOLUTION GRANTING A <br />STATION AT THE SOUTHEAST <br />STREBT. <br /> <br />Since this applicant has expressed <br />for the Truxtun Codes program, the <br /> <br /> King, the following resolution <br /> <br />USE PERMIT FOR THE OPERATION OF AN AUTOMOTIVE SERVICB <br />INTERSECTION OF PORTSMOUTH BOULEVARD AND WOODSTOCK <br /> <br />was <br /> <br /> WHEREAS, Southern Fuel <br />4-2 of the Zoning Ordinance <br />as hereinafter described; and <br /> <br />Distributors, Inc., has made application pursuant to Section <br />of the City of Portsmouth, 1961, for the granting of a use permit <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />done in connection with said application, and the Planning Commission has <br />granting of said use permit, subject to the conditions hereinafter stated. <br /> <br />required to be <br />recommended the <br /> <br />NOW, THEREFORB, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit herein~f:ter ~esCribed is sought (1) <br />will not adversely affect the health or safety of persons residing or working in the neighbor- <br />hood of the proposed use, (2) will not be detrimental to the public welfare or injurious <br />to property or improvements in the neighborhood, and (S) will be in accord with the purposes <br />of said Zoning Ordinance. <br /> <br /> B. That Southern Fuel Distributors, Inc. is hereby granted a use permit subject to <br />site plan restrictions, pursuant to Section 4-2 of said Zoning Ordinance for the operation <br />of an Aumotive Service Station located on the property described as follows: <br /> <br />Beginning at the southeast corner of Portsmouth Boulevard and Woodstock <br />Street; thence east along Portsmouth Boulevard approximately 110 feet <br />to Montclair Avenue; thence south along Montclair Avenue approximately <br />155 feet to an alley; thence west along said alley approximately 110 feet <br />to Woodstock street; thence north along said street approximately 145 feet <br /> to Port~mouth Boulevard, the point of beginning. <br /> <br />C. That such use permit is granted subject to the following conditions: <br /> <br />(1) <br /> <br />(2) <br /> <br />This Use Permit must be framed under glass and kep~ ~nppub~ipuRigplay at <br />all times when the station is open for business, to allow the operator <br />and Zoning Officer to check compliance, <br /> <br />The owner shall provide and the operator shall maintain a five ~6ot high <br />vegptable planting screen along the rear line, which is a residential <br />side property line on Woodstock Street. Details are shown on the site <br />~lan filed with the Zoning Officer," <br /> <br /> Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br />On motion adjourned. <br /> <br />APPROVED - <br /> <br />City Clerk <br /> <br /> <br />
