~.~.~t 1D lq71 <br /> <br />"RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT RELEASING CERTAIN <br />UTILITY EASEMENTS ON COTTON STREET AND STEWART AVENUE. <br /> <br /> WHEREAS, this Council by ordinance adopted on May 23, 1961, did close and vacate the <br />hereinafter described streets; and <br /> <br /> WHEREAS, by said ordinance, this Council did reserve unto the City of Portsmouth a <br />perpetual easement within the right of way of the hereinafter described streets for the pur- <br />pose of maintaining, operating and replacing any and all public utility lines within said <br />streets; and <br /> <br /> WHEREAS, no such utility lines presently exist within the right of way of said streets; <br />and <br /> <br /> WHEREAS, the retention of such a perpetual easement is no longer necessary nor of use <br />to the City of Portsmouth; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby, is authorized to execute a Deed of Release as is attach- <br />ed hereto which said Deed of Release will abbrogate said perpetual easement as was reserved <br />under the aforesaid ordinance and as presently exists within the right of wa)' of the follow- <br />ing streets: <br /> <br />(1) Cotton Street, between Hill Avenue and Stewart Avenue (sometimes known as <br /> Stewart Street). <br /> <br />(2) Stewart Avenue (sometimes known as Stewart Street), between Wesley Street <br /> and Detroit Street.:: <br /> <br />Ayes: Holley, Johnsan, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />UNFINISHED BUSINESS <br /> <br />71-323 - <br /> <br />The following ~rdinance approved at last meeting, wms taken up and read: <br /> <br /> "AN ORDINANCE TO AMEND SECTION 2-24 OF THE CODE OF THE CITY OF PORTSMOUTH, <br /> VIRGINIA, 1961, PERTAINING TO REQUESTS FOR PERMISSION TO ADDRESS THE COUNCIL." <br /> <br /> On motion of Mr. Turner and seconded by Mr. Raymond Smith, the ordinance was adopted, <br />and by the following vote: <br /> <br /> Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br /> 71-324 The following ordinance approved at last meeting, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND SECTION 1 OF ORDINANCE NO. 1971-63, INCREASING THE NUMBER <br />OF CITIZEN MEMBERS ON THE PORTSMOUTH ZONING ORDINANCE STUDY COMMISSION," <br /> <br /> On motion of Mr. Raymond Smith and seconded by Mr. King, the ordinance was adopted, <br />and by the following vete: <br /> <br /> Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br />71-325 The following ordinance approved at last meeting, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND SECTIONS 18-1S9, 18-164, AND 18-171, PERTAINING TO THE <br />DESIGNATION AND OPERATION OF PARKING LOTS AND THE PENALTIES FOR OVERTIME PARK- <br />ING AND TO REPEAL SECTION 18-16S, PERTAINING TO THE RATES FOR PARKING ON LOTS <br />PREVIOUSLY TRANSFERRED TO THE PORTSMOUTH PARKING AUTHORITY." <br /> <br /> On motion of Mr. King ans seconded by Mr. Raymond Smith, the ordinance was adopted, <br />and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />71-326 The following ordinance approved at last meeting, was taken up and read: <br /> <br />"AN ORDINANCE TO REPEAL SECTION 18-92.1 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1961, MAKING CONSTITUTION AVENUE A TWO-WAY STREET BETWEEN COUNTY <br />STREET AND MEANDER ROAD." <br /> <br /> On motion of Mr. Irvine Smith and seconded by Mr. Turner, the ordinance was adopted, <br />and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> <br />
