January 12, 1999 <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING A MEMORANDUM OF INTENT AND A LONG- <br />TERM AGREEMENT WITH THE CITY OF NORFOLK FOR JOINT SHARING OF <br />WATER RESOURCES. <br /> <br /> WHEREAS, Portsmouth and Norfolk ("the Two Cities") are regional water <br />suppliers, joined by a common history, united in a consistency of purpose; and <br /> <br /> WHEREAS, the Two Cities are resolved to improve fiscal strength, <br />competitiveness and opportunities for growth for themselves and the region, for the <br />ultimate purpose of improving the quality of life for their citizens and all citizens of the <br />region; and <br /> <br /> WHEREAS, toward these ends, the Two Cities have established a record of <br />working cooperation on projects of common and regional interest, including: <br /> <br />- the creation of a joint Empowerment Zone application; <br /> <br /> - support for critical regional transportation initiatives such as the Third <br />Crossing, expansion of the Midtown Tunnel and development of the Pinners Point <br />Connector, and the creation of a Fourth Terminal for the Virginia Port Authority; <br /> <br /> - state compensation for state tax-exempt properties and unfunded state <br />mandates; and <br /> <br /> - special events and heritage tourism through the "Trail of Two Cities" <br />program; and <br /> <br /> WHEREAS, the Two Cities have exhibited their sense of regional water <br />responsibility and cooperation through participation in such programs as "HR WET," <br />a regional water conservation effort, the regional well water mitigation program, <br />support for a model watershed management ordinance and recommended changes <br />to state water law; and <br /> <br /> WHEREAS, it is in the common interest of the Two Cities to cooperate in <br />tangible ways to strengthen their public water supply systems for their own benefit <br />and for the region's benefit; and <br /> <br /> WHEREAS, building on the strengths of the Two Cities' regional water <br />systems, a greater joint capacity is created and a greater opportunity for water <br />resource protection is realized; and <br /> <br /> WHEREAS, it is the overall intent of the Two Cities to make water more readily <br />available to sister localities at fair rates so as to create for those localities enhanced <br />opportunities for well-planned growth; and <br /> <br /> WHEREAS, the City Managers of the Two Cities have signed a non-binding <br />Memorandum of Intent, a copy of which is attached hereto, setting forth the principles <br />by which they intend to jointly provide additional treated water to other area localities <br />and water authorities; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that the execution of the Memorandum of Intent by the <br />Portsmouth City Manager is hereby ratified and approved; and the City Manager is <br />further authorized and directed to negotiate and then to execute and to deliver, for <br />and on behalf of the City, a binding long-term contract with the City of Norfolk <br />consistent with the Memorandum of Intent." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
