September 15, 1971 <br /> <br />At a regular meeting of the City Council, held on September 15, 1971, there were~present:~ <br /> <br />Jack P. Barnes, James W. Holley, Burrell R. Johnson, Isaac W. King, R. Irvine Smith, <br />Raymond B. Smith, Raymond Turner, A. P~ Johnson, Jr., City Manager and C. M. Scialdone, <br />Assistant City Attorney. <br /> <br />The meeting was called to order at 7:30 P.M. by Mayor Jack P. Barnes. <br /> <br />Prayer was offered by Councilman Isaac W. King. <br /> <br />Mayor Barnes extended a word of welcome to all of the visitors in attendance. <br /> <br /> On motion of Mr. Irvine Smith and seconded by Mr. Turner, to dispense with the reading <br />of the minutes of the meetings~on~Augu~4, and August 26, 1971, and to accept the written <br />minutes as presented to Council was adopted, without dissenting vote. <br /> <br /> 71-385 Resolutions of Appreciation <br />Lively for his participation on the Board <br />his participation on the Portsmouth School <br /> <br />were presented by Mayor Barnes to Mr. Warren P. <br />of Architectural Review and to Mr. Paul Wilson <br /> Boamd. <br /> <br />for <br /> <br /> 71-397 Certificates of Merit were presented to the Virginia Chemicals, Inc., accepted <br />by Mr. Peter Eustis and to the Coca-Cola Bottling Works, Inc., for their cooperation of PACE. <br /> <br />The following reports from the City Manager were read <br /> <br /> 71-398 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $14,765 for a police training and education program. <br /> <br /> These are Federal funds which the City has received under the LEO Program to conduct a <br />training program for police officers. This is a three-fold project which will establish a <br />§O-hour in-service training program for all police officers, including visual aids. Textbooks <br />for officers working towards college credits will be provided and also funds to send three <br />officers to specialized courses in drug control, forensic studies and riot control. The City <br />is matching these funds with in~ind services." <br /> <br /> On motion of Mr. Irvine Smith and seconded by Mr. Raymond Smith, the following ordinance <br />was approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $14,765.00 FROM THE GENERAL CAPITAL IMPROVEMENT <br />FUND FOR A POLICE TRAINING PROGRAM." <br /> <br />Ayes: ~Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />~ays: None <br /> <br /> 71-599 "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $112,800. The City of Portsmouth has been granted these funds for a Man- <br />power Development Program under the Emergency Employment Act of 1971. $11,$00 of this will <br />be local in-kind services as required under this act. <br /> <br /> The basic purpose of this Emergency Employment Act is to provide additional public <br />service jobs as a means of combating rising unemployment. These funds will create a total <br />of 18 additional positions throughout the City Government, with the highest priority of <br />employment being placed on returning Vier Nam veterans. The program will be in effect from <br />September 1, 1971 through August $1, 1972." <br /> <br /> On motion of Mr. Turner and seconded by Mr. Irvine Smith, the following ordinance was <br />approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $112,800 FROM THE GENERAL FUND FOR THE MANPOWER <br />DEVELOPMENT PROGRAM OF THE CITY OF PORTSMOUTH UNDER THE EMERGENCY EMPLOYMENT <br />ACT OF 1971." <br /> <br />Ayes:~ Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 71-400 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This establishes procedures and penalties for violations pertaining to parking regula.tions <br />on parking lots operated by the Portsmouth Parking Authority. <br /> <br /> It has been established that it is necessary for the adoption of this ordinance to <br />give the Police Department authority to enforce the regulations on ~the off-street parking <br />lots that are under the jurisdiction of the Parking Authority. This will apply to all lots <br />presently operated by the Authority and any that they acquire in the future." <br /> <br /> The following letter from Mr. M. A, Korb, Jr., City Attorney, was read: <br /> <br /> "At the direction of the Council, I have draftedaan ordinance amending the City Code ~y <br />adding thereto a new section numbered Section 18-175.1 providing penalties for overtime park- <br />ing in parking lots operated by the Portsmouth Parking Authority. The Attorney General of <br />Virginia is of the opinion that the City has the power to adopt such an ordinance and although <br />he has cited good reasons why this should be so, he has not cited any specific authority for <br />the adoption of such an ordinance. I have examined the matter very carefully and I can find <br />no authority for the City Council to adept this ordinance." <br /> <br /> On motion of Mr. Johnson and seconded by Mr. Raymond Smith, the following ordinance was <br />approved on first reading, and by the following vote: <br /> <br /> <br />
