S. Livesay, Attorney, spoke in favor of the petition. <br /> <br /> Mr. Johnson made a motion that was seconded by Mr. Raymond Smith to deny the petigion. <br />This motion was defeated by the'following vote: <br /> <br />Ayes: Johnson, Raymond Smith <br />Nays: Hotley, Turner, King, Irvine Smith, Barnes <br /> <br /> Mr. Johnson made a motion to reconsider and defer action on the above Use Permit until <br />Council meeting, October 12, 1971, this was seconded by Mr. Raymond Smith, and was defeated <br />by the following vote: <br /> <br />Ayes: Johnson, Raymond Smith, Barnes <br />Nays: Holl. ey, King, Irvine Smith, Turner <br /> <br />The following resolution was adopted by the original vote: <br /> <br />~'A RESOLUTION 6RANTING A USE PERMIT FOR THE CONSTRUCTION AND OPERATION OF <br />A COMMERCIAL RADIO MAST AND ASSOCIATED TRANSMISSION FACILITIES LOCATED ON <br />LANDS HEREINAFTER DESCRIBED. UP 71-? <br /> <br /> WHEREAS, Suffolk Broadcasting Corporat.ion has <br />of the Zoning Ordinance of the City of Portsmouth, <br />as hereinafter descr£bed; and <br /> <br />made application pursuant to Section 4-2 <br />1961, for the granting of a use permit <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application,~ and the Planning Commission has considered the <br />granting of said usg permit, subject to the conditions hereinafter stated. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit hereinafter described is ~ought (1) will <br />no% adversel~ gffect~ the heal'th or safety of persons residing ~o'r working in the neighbor- <br />hood of the proposed use, (2) will not be detrimental to the public welfare or injurious to <br />property or improvements in the neighborhood, and (3) will be in accord with the purposes <br />of said Zoning Ordinance. <br /> <br /> B, That Suffolk Broadcasting Corporation, is hereby granted a use permit, subject <br />to federal regulations, pursuant to Section 4-2 of said Zoning Ordinance for the construction <br />and operation of a commercial radio mast and associated transmission facilities located on <br />the property described as follows: <br /> <br />A parcel of land rectangular in shape and approximately 460 feet by <br />395 feet; one side of which abuts the Twin Pines Subdivision for 460 feet and <br />one side of which abuts the rear of Lots 323-329, both inclusive of the <br />Merrifields Subdivision, for 395 feet; and the other two sides will abut <br />vacant land owned by Harry L. Trotman, Jr., et als; together with a perpetual <br />right of ingress and egress to reach said rectangular parce% over and along a <br />strip of land SO feet in width extending f~om the existing deadend o~ Green- <br />brook Drive in a northerly direction and abutting the rear of Lots 530-529 <br />of the Merrifields Subdivision." <br /> <br />USE PERMIT 71-8 - T.
