King, <br /> City Manager, <br /> <br />in the City Council <br /> <br /> R. Irv.ine Smith, <br /> M. A. Korb, Jr., <br /> <br /> On motion of Mr. Irvine Smith and seconded by Mr. Turner the reading of the minutes of <br />the regular Council meeting held on November 23, 1971, was dispensed, and the minutes were <br />approved as received by the City Council, was adopted by the following vote: <br /> <br /> Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br /> The following reports from the City Manager were read: <br /> <br /> 71-547 ~ "I submit the mttached resolution and recommend its adoption. This resolution <br />requests the State Highway DeFartment to ,acquire, the right-of'way necessary for th'e improve- <br />ments to Victory Boulevard. <br /> <br /> It is neces,sary to acquire several small parcels of land: to improve various intersections <br />along Victory Boulevard. This is being accomplished under the TOPICS Program to upgrade <br />this street. The Highway Department has agreed to acquire the property and in order for <br />them to do so, it is necessary that the City Council authorize the Highway Department <br />to do so. This resolution also agrees to reimburse the Highway Department 1S% of the <br />cost of acquisition." <br /> <br /> On motion of Mr. King and seconded by Mr. Irvine Smith, the following resolution was <br />adopted, and by the following vote: <br /> <br />"RESOLUTION REQUESTING THE STATE'HIGHWAY COMMISSION TO ACQUIRE THE RIGHT OF WAY <br />FOR THE IMPROVEMENT OF VICTORY BOULEVARD, PROJECT 5504-124-102, RW-201. <br /> <br /> WHEREAS, Section 33.1-'89 of the Code of Virginia, as amended by the 1970 session of <br />the General Assembly, authorizes the State Highway Commissioner to acquire rights of way <br />for the construction, .reconstruction, alteration, maintenance and 'repair of public highways <br />within municipalities on projects which are constructed with State or Federal participation; <br />and <br /> <br /> WHEREAS, Section 33.1-89, as amended, further provides that the State Highway Commissione <br />may exercise such authority Only upon receipt of official request from the city or town <br />involved; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of Portsmouth hereby requests <br />the State Highway Commissioner to acquire the necessary rights of way for Project 5504- <br />124-102, RW-201 within the Corporate Limits of said City and to convey the title to such <br />right of way to the City of Portsmouth upon completion of the project. The City of Portsmouth <br />agrees to reimburse the State Highway Department for fifteen percent (15%) of all costs <br />incurred in the acquisition and conveyance of such rights of way and it is understood that <br />such acquisitions will be handled by the Commissioner under established policies and procedure <br />and his decision in all instances shall be final." <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 71-548 "I submit the attached ordinance-and recommend it be placed on first reading. <br />This amends sections of the City COde and also adds new sections pertaining to rioters <br />and disorderly conduct. <br /> <br /> This ordinance is requested in order that the City can conform to amendments made <br />by the General. Assembly pertaining to disorderly conduct. These~seCtions Will parallel the <br />State law and allow any fines imposed by the ~ourts to be retained by the City." <br /> <br /> On m~tion of Mr. Turner and seconded byMr. Raymond Smith, the following ordinance was <br />approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />BY AMENDING SECTION 19-55 and 19-56 THEREOF, AND BY ADDING THERETO ELEVEN <br />NEW SECTIONS NUMBERED 19-S6.1 THROUGH 19~S6.11,ALL PERTAINING TO RIOTOUS <br />AND DISORDERLy CONDUCT SO AS TO CONFORM TO RECENT CHANGES IN THE STATE LRW." <br /> <br /> Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br /> 71-549 -~"At the Council meeting on November 9, 1971 I was instructed to have a headcount <br />made of children riding buses to and from school within the City. This count was to be made <br />on buses owned and operated by the Community Motor Bus Company and on those operated by the <br />Portsmouth School System. At sometime between November-17 and November 24, representatives <br />of the City counted chitdreD loading and unloading at each school within the City served by <br />Community buses. Since a count is made daily at the schools in the Churchland area served <br />by yellow buses in order to arrive at the average daily attendance, we have used counts made <br />during the entire month of October and the figures shown are the average daily attendance for <br />this month on each bus loading and unloading at each school. <br /> <br /> <br />
