Barnes, James W. Holley, Burrell R. Johnson, Isaac W. King, Raymond B. Smith, <br />Raymond Turner, A. P. Johnson, Jr., City Manager, M. A. Korb, Jr., City Attorney, <br />and W. J. O'Brien, Jr., Assistant City Attorney. <br /> <br />Absent: R. Irvine Smith <br /> <br />Prayer was offered by Councilman Isaac W. King. <br /> <br /> On motion of Mr. Ra~ond <br />of the minutes of the meeting <br />was adopted by unanimous vote <br /> <br />Smith and seconded by Mr. Johnson, to dispense with the reading <br />held on December 7, 1971, and to approve same as presented, <br /> <br />The following reports from the City Manager were read: <br /> <br /> 71-568 'I submit the attached ordinance and recommend it be placed on first reading. <br />TRis is a revised ordinance pertaining to the confinement of dogs that the City Council <br />requested be presented at this meeting. <br /> <br /> This ordinance requires that dogs weighing less than S0 pounds have 100 sq. ft. of <br />exercise area, with an additional 50 sq. ft. for each additional dog less than 50 pounds. <br /> <br /> For dogs weighing S0 pounds or more, it requires 1S0 sq. ft., and for each additional <br />dog over 50 pounds, an additional 75 sq. ft." <br /> <br /> On motion~of Mr. Raymond Smith and seconded by Mr. J~hnson, the following ordinance <br />was placed on first reading, and was defeated by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, BY ADDING <br />THERETO A NEW SECTION NUMBERED 3-14.1 PERTAINING ~O REQUIRED EXER£~SE AREA." <br /> <br /> Ayes: None <br /> Nays: Holley, J~hnson, King, Raymond Smith, Turner, Barnes <br /> <br /> The following letter received from Mr. Victor G. Boland, 216 Webster Avenue, was read: 1 <br /> "I wish to be heard on the dog law (anti-dog law), at your meeting on December 21, 19'71.1,I <br /> Mr. Boland spoke. <br /> <br /> The following letter received from Mr. & Mrs. Jacob C. Vance was read: <br /> <br /> "I, Jacob C. Vance, Sr., and my wife, Elsie M. Vance, reppectfully request to be put <br />on the agenda, to speak on the ordinance pertaining to confinement of dogs, Tuesday, <br />December 21, 1971." <br /> <br />Mr. Vance spoke. <br /> <br /> Motion of Mr. Johnson and seconded by Mr. Raymond Smith, that a stronger ordinance <br />than :is now in effect be imposed upon dogs allowed to run on private or public prope:ty <br />of others and that a heavier fine be imposed upon owners of the dog. who is allowed to run <br />loose (in violation of the ordinance) and that this ordinance be enforced, was adopted by <br />the following vote: <br /> <br />Ayes: Holley, Johnson, Raymond Smith, Turner, Barnes <br />Nays: ~ <br /> <br /> 71-569 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $S0,000 for the City's third annual payment on the Park View Conservation <br />Project. The City is required to make four annual cash payments and the final one will <br />be due in December, 1972. <br /> <br />These funds are available from the previous sale of a bond issue to cover this cost." <br /> <br /> On motion of Mr. Turner and seconded by Mr. Holley, the following ordinance was <br />approved on first reading, and by the fellowing vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $S0,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT <br /> FUND FOR THE PARK VIEW CONSERVATION PROJECT VA. R-48." <br /> <br />Ayes: <br />Nays: <br /> <br />Holley, J6hnson, King, Raymond Smith, Turner, Barnes <br />None <br /> <br /> 71-570 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $15,000 from the Capifal Fund for improvements made to the ~ire Head- <br />quarters building. <br /> <br /> This appropriation is being requested in order that expenditures that have previously <br />been made in the General Fund can be transferred to the Capital Fund to be bonded at a <br />future date. These were long-term improvements made to the building and should not have <br />been charged to operating costs." <br /> <br /> <br />
