10' <br /> <br />,lanuarv l]_ 1972 <br /> <br /> (g) In any such election, if a majority of the votes cast on the question of removal <br />be affirmative, the candidate receiving the highest number of the votes cast sh~ll be de- <br />clared elected and if more than one councilman is removed at such election the candidates <br />receiving the highest number of votes, equal in number to the number of councilmen removed, <br />shall be declared elected. The officer whose removal is sought shall thereupon be deemed <br />removed from office upon the announcement of the official canvass of the election. The <br />successor of any officer so removed shall hold office during the unexpired term of his prodee <br />cessor. In case the person or persons receiving the highest number of votes shall fail <br />to qualify within ten days after receiving notification of his election, the office shall <br />be deemed vacant. The question of the removal of any officer shall not be submitted to <br />the electors a second time during the same term of office, until after the expiration of <br />one year from the determination of the first application for his removal. The method of <br />removal herein provided is cummulative and additional to such other methods as may be pro- <br />vided by law." <br /> <br />Ayes: ttolley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />The following reports from the City Manager were read: <br /> <br /> 72-3 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This amends Section 1083 of the City Code pertaining to taxation on utility services for <br />residential units. <br /> <br /> The ordinance provides that where a master meter is installed for more than one resident <br />ial unit, the tax will be multiplied by the number of single family residential units served <br />by the meter. <br /> <br /> It is my understanding that FHA is approving apartment projects allowing master meters <br />to be installed with the developer installing the service from the meter to the individual <br />apartments. The developer is then allowed to increase the rent to cover the utility costs. <br />This could have a substantial effect on the utility tax revenue. As an example, a two hundre <br />unit complex ~ould result in the following loss: <br /> <br />Master Meter <br />20% of first $1,000 (Commercial Rate) $200.00 <br /> <br />Individual Meters <br />20% of first $17.00 @ $3.40 <br />Revenue loss to City per month <br /> <br />$680.00 <br />$480.00" <br /> <br /> On motion of Mr. Raymond Smith and seconded by Mr. Johnson, the following ordinance <br />was approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND SECTION 10-83 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1961, PERTAINING TO THE RATE OF TAXATION ON UTILITY SERVICES FOR <br />RESIDENTIAL UNITS." <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 72-4 "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $85,000 for the purchase of two fire pumpers. <br /> <br /> Funds were provided in the last bond sale and are available for these two pumpers. <br />They will replace two old pumpers in our annual program for modernizing the fire fighting <br />equipment." <br /> <br /> On motion of Mr. Irvine Smith and seconded by Mr. Raymond Smith, the following ordinance <br />was approved on first readiag,joand by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $85,000.00 FROM THE GENERAL CAPIT$L IMPROVEMENT <br />FUND FOR THE PURCHASE OF TWO NEW FIRE ENGINES." <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, lmrner, Barnes <br />Nays: None <br /> <br /> 72-5 - "I submit the attached resolution and recommend its adoption. This appoints <br />five viewers for the closing of a street known as Virginia Route 653. <br /> <br /> The road is located in the industrial tract in West Norfolk where the new sugar-refineryl <br />xs proposed. The Plann%ng Commission has recommended it be closed and a copy of the Com- <br />mission s. letter is attached hereto. <br /> See letter from Director of Planning - page 102 <br /> O~3-mO~B~ ~f.l~P. I~mng ag secgnded by Mr. Turner, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF A PAPER STREET <br /> KNOWN AND DESIGNATED AS VIRGINIA STATE ROUTE 653. <br /> <br /> WHEREAS, Tasty Baking Company has made application to vacate and close the hereinafter <br />described portion of a certain paper street and it appearing that notice of the application <br />and request for the appointment of viewers was duly posted on December 30, 1971, on the <br />bulletin board of the-Court of Hustings for the City of'Portsmouth, on the bulletin board <br />of the Circuit Court of the City of Portsmouth, and on the bulletin board of the Municipal <br />Court of the City of Portsmouth. <br /> <br /> <br />
