C. NORCOM HIGH SCHOOL." <br /> <br />,'..~Ayes: Holley, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br /> 72-35 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This amends Section 5 of the License Tax Ordinance pertaining to fines and penalties for <br />non-payment. <br /> <br /> The amendment provides for a penalty in the amount of 10% of the tax if failure to <br />pay is for more than thirty days, with an additional 5% for each thirty days or fraction <br />thereof. The maximum penalty is not to exceed 30% in the aggregate. Such penalty in no <br />case shall be less than $2.00. <br /> <br /> With the adoption of this ordinance, it is hoped that the license taxes will be paid <br />on time to avoid the progressive penalty." <br /> <br /> On motion of Mr. King and seconded by Mr. Holley, the following ordinance was approved <br />on first reading, and by the loll'owing vote: <br /> <br />"AN ORDINANCE TO <br />PORTSMOUTH, 1969, <br />TAXES." <br /> <br />~END SECTION 5 OF THE LICENSE TAX ORDINANCE OF THE CITY OF <br /> PERTAINING TO FINES AND PENALTIES FOR NON-PAYMENT OF LICENSE <br /> <br />Ayes: Holley, King, Irvine Smith, Raymond Smith, Tummer, Barnes <br />Nays: None <br /> <br /> 72-36 "I submit the attached <br />faithful performance by the City in <br />for the 1-264 eastbound off-ramp to <br /> <br />resolution and recommend its adoption. This guarantees <br />construction of a storm drain into the drainage ditch <br />Frederick Boulevard. <br /> <br /> Plans have been developed for the storm drainage system in North Truxtun and to accom~] <br />plish this, it is necessary to install pipe within the Interstate right-of-way. The State <br />Highway Department requires the adoption 'of this resolution in order that the thirty-one <br />feet of storm drain pipe can be installed." <br /> <br />"RESOLUTION GUARANTEEING FAITHFUL PERFO~iANCE OF THE CONTP~CT TO CONSTRUCT <br />A STORM DRAIN INTO THE DRAINAGE DITCH FOR THE 1-264 EASTBOUND OFF-RAMP TO <br />FREDERICK BOULEVARD. <br /> <br /> WHEREAS, the City of Portsmouth plans to contract to construct thirty-one feet of <br />1S" R.C.P. storm drain pipe with a R.C.P. flared end section from the northern righ~e6~aFay <br />~f Trexler Avenue into the drainage ditch for the 1-264 eastbound off-ramp to Frederick <br />Boulevard which ditch is to be paved for a distance of twentyfive feet; and <br /> <br /> WHEREAS, all work will be in accordance with the applicable State and Federal Regulatio~ <br />as shown on sheet 4 of the contract plans; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />that the City of Portsmouth guarantees faithful performance of the above mentioned work <br />in accordance with the rules and regulations of the State Highway Commission of Virginia <br />and in compliance with the terms of the permit issued by the Virginia Department of Highways.l" <br /> On motion of Mr. Turner and seconded by Mr. Irvine Smith, the above resolution was <br />adopted, and by the following vote: <br /> <br />Ayes: Holley, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 72-3~ - "I submit the attached letter from the Portsmouth Highway Safety Commission. <br />With regards to the Commission's second request concernin~ the railroad crossings, I have <br />conferred with the City Attorney and he advises that the City Council can adoot an ordinance <br />regulating the trains over these street crossings." <br /> <br /> (1) On motion of Mr. Holley and secon~e~b%~Mr~.I~linc Smith, that the unexpired <br />term of Dr. Luther McRae, member of the R&rt~o6~ High~ay~sAfety Commission, to be de- <br />ferred to a conference, was adopted by the following vote: <br /> <br />Ayes: Holley, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> (2) On motion of Mr. Raymond Smith and seconded by Mr. Holley, to concur with the <br />recommendation of Portsmouth Highway Safety Commission, requesting two railroads not to <br />run trains in peak hours, and to be referrmd to the City Attorney, was adopted by the fol- <br />lowing vote: <br /> <br />AFes: Holley, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> <br />
