O'Bri~n, Jr., City Attorney. <br /> <br />opened with prayer by Councilman King. <br /> <br />Mayor Barnes extended a welcome to all visitors in attendance. <br /> <br /> Motion of Mr. Turner and seconded by Mr. Irvine Smith, the minu~es of the Public <br />Hearing meeting., held on June 12, 1972, to be accepted as received, by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond smith, Turner, Barnes <br />Nays: None <br /> <br /> Motion of Mr. Johnson and <br />meeting, held on June 13, 1972, <br />the following vote: <br /> <br />seconded by Mr. <br />to be approved <br /> <br />Holley, minutes of the regular City Council <br />as corrected Item 72-254 - "downtown", by <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />The following reports from the City Manager were read: <br /> <br /> 72-260 "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $150,000 for equipment for I. C. Norcom High School. <br /> <br /> These funds will be used to purchase the equipment necessary to operate the technical <br />classes that will be offered at I. C. Norcom High School beginning in September. The <br />funds are available and will not require bonds to be issued." <br /> <br /> On mo{ion of Mr. King and seconded by Mr. Raymond Smith, the following ordinance was <br />approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $150,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT <br />FUND TO PURCHASE EQUIPMENT FOR I. C. NORCOM HIGH SCHOOL." <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 72-261 "I submit the attached resolution and <br />condemnation proceedings to acquire certain parcels <br />access road in Hattonsville. <br /> <br />recommend it be adopted. This authorize~ <br />of land needed for the industrial <br /> <br /> The condemnation involves three parcels of land. One parcel we have not been <br />able to agree on price and the other two have title deficiencies." <br /> <br /> On motion of Mr. Raymond Smith and seconded by Mr. King, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF <br />PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 471 <br />OF THE ACTS OF ASSEMBLY OF 1970, SAID PROPERTY BEING NECESSARY FOR THE CON- <br />STRUCTION OF AN INDUSTRIAL ACCESS ROAD TO BE LOCATED BETWEEN LAIGH ROAD AND <br />VICTORY BOULEVARD. <br /> <br /> WHEREAS¢.i~he City of Portsmouth has found it necessary to acquire the interests <br />hereinafter specified in and to hereinafter described parcels of land situate in the City <br />of Portsmouth,-¥irginia, for the purpose of constructing an industrial access road; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described <br />herein, necessary to the project, because the owners thereof and the City have not been <br />able to.agree upon the price to be paid therefor, or the City has not been able to locate <br />certain of the owners.or because of the status of the title of the property; and <br /> <br /> WHEREAS, advancement of the work and use of said project will be delayed unreasonably <br />if the said property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLFED by the Council of the City of Portsmouth, Virginia: <br /> <br /> t. The City attorney is directed to institute eminent domain proceedings, employing <br />special counsel for that purpose if he deems it advisable, against the following property <br />situate in the City of Portsmouth, for the purpose of acquiring fee simple title therein, <br />together with any and all easements~of access, light or air incident to the lands of the <br />landowner abutting upon said property; in accordance with and pursuant to Sections 2.06, <br />2.07 and 2.08 of the Charter of the City of PortsmOuth (Chapter 471 of the Acts of Assembly <br />of 19.70 as amended), and to deposit to the credit of the court as provided by law the sum <br />hereafter specified to compensate tke owners of the parcels of land, as shown on those <br />certain plans entitled '~irginia Department of Highways Project #9999-124-101-C-501", <br />dated February 8, 1972, sheet 5, copies of which are filed with the Department of Engineering <br />of the City of Portsmouth, Virginia. <br /> <br /> <br />
