<br />VIRGINIA, 1961, SUCH CHAPTER BEING THE SUBDIVISION ORDINANCE OF THE CITY
<br />OF PORTSMOUTH, BY ADDING SECTION 32-19.1 THERETO .PERTAINING TO REQUIRED
<br />OFF-SITE DRAINAGE IMPROVEMENTS."

<br /> On motion of Mr. Smith and seconded by Mr. Johnson, the ordinance was adopted,

<br /> The following letter frem Donald R. Steele, President, Hedges Ferry Home Owners
<br />Association, was read:
<br />
<br /> "At a public hearing on August 7, 1972, the City Council approved a petition for
<br />rezoning property on Hedges Ferry Road near Portsmouth Boulevard from EommerciaI C-1
<br />to Commercial C-2~ As president of the Hedges Ferry Property Owners Association, I would
<br />like to request an opportunity to speak at the City Council meeting on August 22, 1972,
<br />during the second reading, in opposition to the rezoning.
<br />
<br /> I am opposed to spot zoning and having Commercial C-2 property immediately adjacent
<br />to residential properties. In speaking for the mezoning, Mr. Kilgore compared the proposed
<br />Village Manor Shopping Center with ehe Plaza Shopping Center in Churchland. The two are
<br />hardly comparable with respect to the closeness.~6f residential property.
<br />
<br /> Mr. Kilgore also inferred that since the residents had not opposed the rezoning of
<br />the property from R-75-S to C-1 they should not be opposed to rezoning from C-1 to C-2.
<br />To say thai~he residents did not publicly voice opposition to C-1 zoning may be true but
<br />residents have been unable to find evidence that a public hearing for the purpose of re-
<br />zoning from R-75-S was ever legally advertised by the Planning Commission.
<br />
<br /> Writers of at least half of the letters presented by Mr. Kilgore as supporting the
<br />skating rink have indicated that they did not realize that the rink was to be adjacent to
<br />housing. Their support was not expressed for a specific location; it was a general en-
<br />dorsement for a skating rink in the City of Portsmouth.

<br />full council on August 22, 1972."

<br /> "We, the undersigned property owners, are opposed to the rezoning of property on
<br />Portsmouth Boulevard and Hedges Ferry Road from C-1 to C-2 as requested by Walter Carter.
<br />The skating rink ~roDosed by Mr. Carter would be detrimental to the community in that this
<br />type of business ~s not in keeping with residential properties adjacent. This type of
<br />business would attract large numbers of people, therefore creating traffic and noise pro-
<br />blems. We strongly urge you to deny this petition for rezoning. Signed by William O. Prince
<br />210 Lewis Road and others"
