Saunders Early, Jr,, James W. <br />King, Raymond B. Smith, Robert W. Wentz, Jr., A. <br />~. J. O'Brien, Jr., City Attorney. <br /> <br />Holley, Burrell R. Johnson, Isaac W. <br />P. Johnson, Jr,i City Aanager, <br /> <br />Prayer was offered by Councilman King. <br /> <br />Mayor Barnes extended a word of welcome to visitors in attendance. <br /> <br /> Motion of Mr. Smith and seconded by Mr. Johnson, minutes of the Public Hearing, held on <br />August 7, 1972, to be approved as received was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> Motion of Mr. Holley and seconded by Mr. Johnson, minutes of the regular City Council <br />meeting, held on August 8, 1972, to be approved as received was adopted by the following <br />vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Bammes <br />Nays: None <br /> <br />The following reports from the City Manager were read: <br /> <br /> 72-346 "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $55,000 from the Capital Improvement Fund for con}truction of a parking <br />area in the Demonstration Block of the Olde Towne Project. This also will provide <br />for drainage and some grading for the ornamental park adjacent to the parking lot. <br />These improvements by the City are part of our commitment to the Olde To,me Project. <br /> <br />Bids were received for this work on August 1, 1972, as follows: <br /> <br />Birsch Construction Corp. <br />Norfolk, Virginia <br /> <br />$54,169.90 <br /> <br />Portsmouth Paving Company <br />Portsmouth, Virginia <br /> <br />$58,798.55 <br /> <br /> The bids were reviewed both by our Engineering Department and by R. Kenneth Weeks Engineers~ <br />Both have recommended that the low bidder be awarded the contract even though the cost <br />is somewhat above their estimates. They do not believe that a lower bid would be obtained <br />if the project were again delayed and re-advertised. <br /> <br /> t recommend that a contract be awarded to Birsch Construction Corporation, Norfolk, <br />Virginia.'? <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following ordinance was <br />approved on first reading, andi~by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $55,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT <br />FUND TO CONSTRUCT A DEMONSTRATION BLOCK IN THE OLDE TOWNE PROJECT, VA. R-49." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> blotion of Mr. Johnson and seconded by Mr. Smith, the contract to~b~ awarded.Cto Birsch <br />Construction Corp., being iow-bidder, was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 72-347 "I submit the attached ordinance and recommend it be placed on first reading. <br />This ~ntroduces certain technical changes to the vacant and unoccupied buildings ordinance. <br /> <br /> These changes to Section 4-73 through 4-79 of the City Code are recommended by the <br />City Attorney to clarify and update these sections. Section 4-75 is a new section defining <br />who constitutes an owner of property. The word "permit" has also been incorporated throughoul <br />the ordinance rather than the word "fee.,' In Section 4-78 under penalties the jail sentence <br />has been removed." <br /> <br /> On motion of Mr. King and seconded by Mr. Smith, the following ordinance was approved <br />on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO A3IBND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />BY ~4ENDING SECTIONS 4-73 THROUGH 4-79 THEREOF, PERTAINING TO CLOSURE OF <br />VACANT OR UNOCCUPIED BUILDING AND REGISTRATION AND PERMITS THEREFOR." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, ~gentz, Barnes <br />Nays: None <br /> <br /> <br />
