Johnson, Jr., <br /> <br /> attendance. <br />Johnson, minutes of the Public <br /> <br />Chamberi <br /> <br /> Hearing meeting <br />1972, to be approved as received, was adopted by the <br /> <br />~yes: Early, Holley, Johnson, King, Smith, ~entz, Barnes <br />Nays: None <br /> <br /> Motion of Mr. Early and seconded by Mr. Johnson, minutes of the regular City Council <br />meeting, held on October 10, 1972, to be approved as corrected Item 72-433 - motion <br />seconded by Mr. King, was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, ~entz, Barnes <br />Nays: None <br /> <br /> Motion of Mr. Smith and seconded by Mr. Johnson, minutes of a called meeting of City <br />Council, held on October 19, 1972, to be approved as received, was adopted by the following <br />vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barn~s <br />Nays: None <br /> <br />The following reports from the City Manager were read: <br /> <br /> 72-446 - "In 1970, the City negotiated with the Seaboard Coast Line Railroad <br />for the purchase of property owned by the railroad to the south of the Municipal Building <br />and east of the Civic Center. The land is currently used for parking and the seawall <br />was constructed on a portion. <br /> <br /> The value of the land was established at $265,500; however, the City did not wish <br />to purchase it all at that time. It was necessary to acquire the portion needed for the <br />construction of the seawall. Under HUD regulations, it required municipal o~nership for <br />the seawall to be constructed. <br /> <br /> In 1970, an agreement was reached with the Seaboard Coast Line Railroad to purchase <br />the land necessary for the seawall construction at a price of $91,900 and the land was <br />purchased. This left a balance of $175,400 for the remainder of the property. Since funds <br />were limited, the railroad agreed to sell the land needed and give the City an option to <br />purchase the balance in two years. <br /> <br /> The option will expire on November 3, 1972. The railroad has requested an expression <br />as to the City's desires concerning ~the purchase of the property, <br /> <br /> I reco~end that the City exercise its option and that the attached ordinance be placed <br />on first reading." <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the follw~ing ordinance was approved <br />on first reading and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $173,400 PROM THE CONSTRUCTION FUND FOR THE <br />PURCHASE OF A CERTAIN PARCEL OF LAND LOCATED ON CRAIiFORD STREET IN THE <br />CITY OF PORTSMOUTH, VIRGINIA." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, ~entz, Barnes <br />Nays: None <br /> <br /> 72-447 - "I submit the attached ordinance and recommend it be p%aCed on first reading. <br />This amends the City Code pertaining to certification of compliance f~rental dwellings <br />by adding Sections 4-80 through 4-86 pertaining to the prohibition of'ihe use of lead-based <br />paint on building surfaces. <br /> <br /> The ordinance prohibits the use of lead-base paint or any substance containing lead <br />in ~xcess of five-tenths per centum by ~eight in all residential property. This applies <br />to ~nterior surfaces of any dwelling unit, rooming house, or facility which may be occupied <br />or used by children or to any exterior surfaces of such buildings accessible to children. <br />h'nen the Director of Public Health determines the presence of lead-~ased paint on any interi- <br />or or exterior surface accessible to children, he sha~l issue ~ not~ce a~d demand for abate~ <br />ment to the o~ner. No o~rner or landlord found to be ~n violation may evict, Or cause to <br />be evicted, occupants with children for the purpose of avoiding corrective maintenance. <br /> <br /> The purpose of this ordinance is to protect children against the hazards of eating <br />lead paint. Lead paint 'is sweet and small children who put everything in their mouths <br />rapidly acquire a taste for it. <br /> <br /> <br />
