November 21~ 1972 <br /> <br /> At a regular City Council meeting held on November 21, 1972, in the City Council <br />Chamber, there were present: <br /> <br /> Jack P. Barnes, E. Saunders Early, Jr., James W. Holley, Burrell R. Johnson, <br /> Isaac W. King, Raymond B. Smith, Robert W. Wentz, Jr., A. P. Johnson, Jr., <br /> City Manager, W. J. O'Brien, Jr., City Attorney. <br /> <br /> Prayer was offered by Councilman King. <br /> <br /> Mayor Barnes extended a word of welcome to visitors in attendance. <br /> <br /> Motion of Mr.~Smith and seconded by Mr. Johnson, to approve the minutes as received, <br />was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 72-482 <br />of the <br />on ~unicipal Finance Commission. *See copy of resolution on page 329 <br /> <br /> 72-483 A public hearing on amendments to Crawford Urban Renewal <br />Redevelopment and Housing Authority with Vernon E. Wimb~ough, Chairman, <br /> <br /> Resolution of appreciation was presented to Mrs. Mildred B. Bartlett in respect1 <br />late Albert C. Bartlett, who served for four years on the City Council and eight years~ <br /> <br />was held by Portsmoutl <br />presiding. <br /> <br />Mr. Irving Mervis, 307 High Street spoke. <br /> <br />The following reports from the City Manager were read: <br /> <br /> 72-484 "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $26,387 for the purchase of library books. This represents funds received <br />from the State annually for the purchase of library books. These funds are not included <br />in the budget as we are not advised until August as to the amount of funds that will <br />be available to the City." <br /> <br /> On motion of Mr. Johnson and seconded by Mr. Smith, the following ordinance was approved <br />on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $26,387.00 FROM THE GENERAL FUND FOR THE <br />?URCHASB OF BOOKS FOR THE PORTSMOUTH PUBLIC LIBRARY." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 72-485 - "I submit the attached resolution and recommend its adoption. This authorizes <br />the construction of a sidewalk along the east side of the 2600 block of Arcadia Avenue. <br /> <br /> It is also necessary at this time for the City Council to hold a public hearing <br />to provide for the abutting property owners to appear before the Council to be heard <br />in favor of or'against such improvement. The property owners on this block have-petitioned <br />for the construction of these sidewalks in accordance with Section 31-S2 of the City Code. <br />This section provides that when not less than 3/4 of the property owners affected petition <br />for the installation of sidewalks that a public hearing will be held and a resolution adopted <br /> <br /> These sidewalks will be installed on the basis of 50% cost to the property owner and <br />50% by the City. After the cost of the improvements has been established, the City Assessor <br />shall apportion to the individual property owners their pro-rata share of 50% of the cost. <br />The property owner will then be required to pay in equal installments over a period not <br />exceeding five years the amount due. This will be billed annually on the real estate tax <br />bill." <br /> <br />A public hearing was held on the above matter. <br /> <br />Capt. Charles Whitehurst, 2617 Arcadia Avenue, spote. <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following resolution was <br />adopted, and by the following vote: <br /> <br />~A RESOLUTION AUTHORIZING THE CONSTRUCTION OF A SIDEWALK ALONG THE EAST <br />SIDE OF THE 2600 BLOCK OF ARCADIA AVENUE BETWEEN 2617 ARCADIA AVENUE <br />AND 3405 TREXLER AVENUE, WHERE STANDARD SIDEWALKS DO NOT NOW EXIST, THE <br />COST THEREOF TO BE APPORTIONED BETWEEN THB CITY AND THE ABUTTING LANDOWNERS, <br />AND DIRECTING THAT AN ABSTRACT OF THIS RESOLUTION BE RECORDED TOGETHER WITH <br />A STATEMENT SHOWING THE ESTIMATED AMOUNT THAT WILL BE ASSESSED AGAINST EACH <br />SUCH LANDOWNER. <br /> <br /> WHEREAS, by petition submitted in accordance-with law certain abutting landowners <br />have petitioned the City of Portsmouth to construct a sidewalk along the east side of the <br />2600 block of Arcadia-Avenue between 2617 Arcadia Avenue and 340S Trexler Avenue, where <br />standard sidewalks do not now exist, the .cost thereof to be apportioned between the City <br />and the abutting landowners; and <br /> <br />WHEREAS, notice has been duly gi.ven to'the~abutting landowners, as provided by law, <br />that a hearing would be held before the Council of the City of PortsmOuth on November 21 <br />1972, at 7:30 P.M., in the Council Chambers; and ' <br /> <br /> <br />
