May 8~ 1973 <br /> <br /> Motion of Mr. Holley and seconded by Mr. Early, to be received as information. <br /> <br /> SuBstitute motion of Mr. Smith and seconded by Mr. E~rly. tRat we direct tRe C~ty <br />Attorney to file a Dismissed Agreed Order in the Court of Appeals in the State and cease <br />any further litigation in the case of City of Portsmouth vs Bide-A-Wee Golf Course. <br /> <br /> Motion of Mr. Johnson and seconded by Mr. Wentz, to apoeal ruling of the Chair to <br />the floor~6_~ep the~matter open (See last m~eting Item 73-158 7 mo~ion of ~lr. ~entz), <br />th~ vote being whether to uphold the Chair, was denied by three to four voice vote. <br /> <br />Substitute motion of Mr. Smith was adopted, and by the following vote: <br /> <br />Ayes: Early, Johnao~, Smith, Wentz, Barnes <br />Nays: Holley, King <br /> <br />- NEW BUSINESS - <br /> <br />73-180 The following letter received from Director of Planning was read: <br /> <br /> "At its regular monthly meeting of May 1, 1973, the City Planning Commission con- <br />sidered Street Closure Application S-73-9 from A~torney Benajamin Levy on behalf of <br />Ballard Associates, Mr. g Mrs. Robert Wentz, Jr., and Mr. & Mrs. Carlton A. Sears to <br />close a Faper street known as Floral Avenue (Lane) extending for the depth of lot on the <br />south side of River Shore Road between Twin Pines Road and the City of ~nsemond bound- <br />ary. The~Commiss.ion recommend§ approval of this street closure application." <br /> <br />* Motion of Mr. Smith and seconded by Mr. Johnson, to be referred to the City Attorney <br />for proper handling, was adopted by the following vote: <br /> <br />Ayes: Early, <br />Nays: None <br />Abs%aining: Wentz <br /> <br />Holley, Johnson, King, Smith, Barnes <br /> <br /> 73-18~ - The following letter received from John V. Turtle, President, River Shore <br />Civic League, was read: <br /> <br /> "Several weeks ago twenty-five members of the River Shores Civic League met with the <br />owners of the tract of land which adjoins the southern side of the River Shores section <br />(the former Ballard property). At this meeting the develppers presented some of their <br />ideas about the property development and they asked for our comments. <br /> <br /> There was unanimous agreement that Floral Lane a paper street should be closed <br />and the League asked Mr. Ben Levy if this was agreeable to his g~mFp. He answered in the <br />affirmative. Th League then contacted the owners of the lots that adjoin Floral Lane and <br />requested that they join Mr. Levy in petitioning the Council to close the paper street. <br /> <br /> The Civic League respectfully requests that the Council give favorable consideration <br />to this closure." (See action taken above)* <br /> <br /> 7S-181 The following letter received from H. C. Richardson, 3644 Wright Road, <br />was ~ead: <br /> <br />late <br />~rea. <br /> <br />"On behalf of the residents of Edgewood Park, <br />to you a request for City help in eliminating <br /> <br />Churchland ar~a, I should like to ~e- <br />a health and safety problem of this <br /> <br /> Edgewood Park is hindered by a network of deep and wide ditches. Serving as a <br />primitive means for drainage, this sys~is a haven for mosquitos and ~ breeding g~oun~ <br />for same. <br /> <br /> On the average of three times a year, the ditches are deepened by the Department of <br />Public Works in an attempt to have the standing ~&~r flow, however, due to the depth the <br />water does not flow, therefore, allowing it to continue to stagnate. <br /> <br /> These unsightly trenches ar~ continuously caving in, thus, adding to the problem of <br />widening. Areas that were 3 feet wide two ago are 4 feet in many situations. T~is will <br />indicate the rapidity of cave-in. <br /> <br /> After many heavy rain falls, four feet of water is realized. <br />sions have fallen into them. <br /> <br />Children on many occa- <br /> <br /> Recently numerous motorist have driven their vehicles into them causing bodily and <br />vehicular damage. <br /> <br /> The citiznns of Edgewood Park request that this long over-due problem be extended <br />corrective action. <br /> <br /> It is, therefore, requested that this matter be placed on the City Council agenda <br />for May 8, 1973.' <br /> <br /> <br />
