23 <br /> <br />Ma~8L 1973 _ __ <br /> <br />At a regular meeting of the City Council, held on May 8, 1973, there were present: <br /> <br />Jack P. Barnes, E. Saunders Early, Jr., James W. Holley, Burrell R. Johnson, <br />Isaac W. King, Raymond B. Smith, Robert W. Wentz, Jr., A. P. Johnson, Jr., <br />City Manager, W. J. 0'Brien, Jr., City Attorney <br /> <br />Prayer was offered by Councilman King. <br /> <br />Mayor Barnes extended a word of welcome to visitors in attendance. <br /> <br /> Motion of Mr. Smith and seconded by Mr. Johnson, to approve the minutes as received, <br />was adopted by the following vote: <br /> <br /> Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br /> Nays: None <br /> 73-161 <br /> Miss LilianaRmAdio, American Field Service Student, of Santa Fe, Argentina, <br />presented a Merrimac Pin and Miss AmAdio responded. <br /> <br />was <br /> <br />The following reports from the City Manager were read: <br /> <br /> 73-162 "I submit the attached resolution and recommend its adoption. This author~ <br />iz~s the proper City officials to sign an agreement between the Seaboard Coast Line <br />Railroad and the City of Portsmouth. This covers the construction of a railroad crossing <br />on the Seaboard Coast Line tracks west of Greenwood Drive. The crossing will be built <br />by the State Highway Department along with the construction of the Greenwood Drive intere <br />change and Interstate 264. <br /> <br /> This railroad crossing is necessary to provide access to the land west of Greenwood <br />Drive and between the Interstate and the railroad tracks." <br /> <br /> Oh motion of Mr. King and seconded by Mr. Smith,the following resolution was adopted, <br />and by the following vote: <br /> <br />"K.RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH <br />THE SEABOARD COAST LINE RAILROAD~COMPANY FOR THE CONSTRUCTION AND MAINTENANCE <br />OF A STREET CROSSING NEAR ~ND TO THE SOUTHWEST OF THE CROSSING OF SAID RAIL- <br />ROAD BY GREENWOOD DRIVE, <br /> <br /> WHEREAS, it is necessary to provide a street crossing of the Seaboard Coast Line <br />Railroad Company railway tracks at a location as shown on a plat as attached hereto; <br />and <br /> <br /> WHEREAS, it is necessary to enter into an agreement with the Seaboard Coast Line <br />Railroad Company with regard to the construction and maintenance of said street crossing. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the form of agreement between the City and the Seaboard Coast Line Railroad Company, <br />dated March 20, 1973, by the provisions of'which the Railroad.Company grants to the <br />City an easement or right of way within the limits therein set out for the construction <br />and maintenance of a public road or street crossing (including the usual appurtenances, <br />such as a paved roadway, curbs, gutters, sidewalks, shoulders, slopes, fills, cuts and <br />drainage facilities) at grade across the right of way and track or tracks of the Seaboard <br />Coast Line Railroad Company at Portsmouth, Virginia; and as particularly described in <br />said agreement and is more fully shown on the print attached to and made a part of said <br />agreement as attached hereto be, and the same hereby is approved. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager and the City Clerk are hereby authorized <br />~nd!directed to execute said agreement in the name and on behalf of the City." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 73-163 - "I submit the attached agreement and recommend the proper City officials <br />be authorized to sign. This is an agreement between the Portsmouth Parking Authority <br />and the City for the construction of a multiple-story parking facility. <br /> <br /> The agreement provides that the City will provide the funds for~the construction <br />of the parking ramp. The Authority will pay to the City all revenues necessary to meet <br />ali payments of the bond issue, The Authority will operate and maintain ali street <br />parking meters, submit a line item budget, and a quarterly revenue repoft. <br /> <br />The City is to issue bonds not to exceed $1,500,000 to finance this project." <br /> <br /> Motion of Mr. Johnson and secondedbby Mr. Smith, to concur in the recommendationoof <br />the City Manager, was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> <br />
