July 24, 1975 <br /> <br /> Motion of Mr. Smith and seconded by Mr. King, that the bid be awarded to Aldo Con- <br />struction Corporation, was adopted by the following vote: <br /> <br />Ayes: Holley, King, Smith, Wantz, Barnes <br />Nays: None <br /> <br /> 73-551 - "I submit the attached resolution and recommend its adoption. This opposes <br />proposed regulations for the control and abatement of air pollution which prohibits the <br />construction or modification of commercial buildings, recreational, shopping centers and <br />highways. <br /> <br /> The State Air Pollution Control Board is holding a Public Hearing on August 6, 1975, <br />at 9:00 a.m. in the House Committee Room No. 4 in the State Capitol Building, Richmond, <br />Virginia. Among the items to be discussed is a change in the regulations that would requi <br />that any source that has or leads to secondary or adjunctive activity which emits or <br />may emit a pollutant for which there is a national standard, they must receive a permit <br />from the State Air Pollution Control Board. Examples of these sources under this control <br />are as follows: <br /> <br />(1) <br /> <br />Major highways and airports. <br /> <br />(2) Large regional shopping centers. <br /> <br />(5) Major municipal sport complexes and stadiums. <br /> <br />(4) <br /> <br />(s) <br /> <br />Large parking facilities. <br /> <br />Large amusement and recreational facilities. <br /> <br />Any other source as designated by the Board. <br /> <br /> This means that building permits granted by Municipal and County Governments no <br />longer constitute complete authority to commence construction or modification of facilitie~ <br />which either in themselves emit pollutants or attract emitters of pollutants, such as <br />motor vehicles. Requirements of the State.Air Pollution Control Board must be satisfied <br />before any construction or modification can commence. <br /> <br /> It is requested that' the Council adopt this resolution strongly opposing this regula~ <br />tion. We will have someone appear at this Public Hearing opposing this regulation. <br />Southeastern Virginia Planning District Commission has taken action and instructed the <br />Chairman to appear in opposition." <br /> <br /> On motion of Mr. Smith and seconded by Mr. Wentz, the following resolution was <br />adopted, and by the following vote: <br /> <br /> "A RESOLUTION EXPRESSING THE STRONG OPPOSITION OF THE COUNCIL OF THE CITY <br /> OP PORTSMOUTH, VIRGINIA, TO A PROPOSED CHANGE BY THE STATE AIR POLLUTION <br /> CONTROL BOARD OF ITS "REGULATIONS FOR THE CONTROL AND ABATEMENT OF AIR <br /> POLLUTION,~ WHICH SAID CHANGE _WOULD PROHIBIT THE CONSTRUCTION OR MODIFICATION <br /> OF ANY STRUCTURES CLASSIFIED'AS POSSIBLEAIR POLLUTION SOURCES OR COMPLEX <br /> AIR POLLUTION SOURCES WITHOUT PRIOR APPROVAL OF BASIC POLLUTION CONTROi <br /> DESIGN AND THE ISSUANCE BY THE BOARD OF A PERMIT THEREFOR. <br /> <br /> WHEREAS, pursuant to rule making power granted by Section 10-17.18 of the Code of <br />Virginia, 1950, as amended, the State Air Pollution. Control-Board shall consider at a <br />public hearing on August 6, 1973, a proposed change to its "regulations for the control <br />and abatement of air pollution".which:'would.prohibit the construction or modification <br />of any structure which would harbor or. produce a possible air pollution source or com- <br />plex air pollution source as defined by said regulations without first obtaining approval <br />of the basic pollution control design of such structure and the issuance by the Board <br />of a permit therefor; and <br /> <br /> WHEREAS, the effect of the adoption of such proposed change would be to deprive <br />the municipality of the complete and ultimate~authority to approve the construction or <br />modification of facilities and the issuance of permits therefor; and <br /> <br /> WHEREAS, it is the sense of the Council.that the adoption of said proposed change <br />would be inimical to local control of construction and community development, such local <br />control being imperative to the rapid, efficient and proper development of the subject <br />community; and <br /> <br /> WHEREAS, it is the sense of the Council that the adoption of said proposed change <br />would inordinately slow the construction of new housing and industry in the City of Portsm <br />mouth at a time when such construction is critical to the future wellbeing of the City; <br />and <br /> <br /> WHEREAS, it is the sense of the Council that the adoption of such proposed change <br />would create a procedure which would exclude from the construction review and planning'~ <br />process the consideration of local conditions; and <br /> <br /> WHEREAS, it is the sense of the Council that a better method of prompting pre-constru <br />tion review of possible air pollution:sources would be by encouraging the adoption of <br />adequate local air pollution ordinances pursuant to Section 10-17.30 of the Code of Virgin <br />19S0, as amended. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council <br />that it hereby expresses its strong opposition to <br /> <br />of the City of Portsmouth, Virginia, <br />any change in the "regulations for <br /> <br />he <br /> <br />e <br /> <br /> <br />
