<br /> 75-562 - The following resolution was presented/ and on motion of Mr. Smith and
<br />seconded by Mr. Johnson, was adopted by the following vote:

<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPLY FOR A PEPJ{IT FROM
<br />THE VIRGINIA DBPARINENT OF HIGHWAYS TO INSTALL A TWELVE INCH DUCTILE
<br />IRON GRAVITY SEWER BETWEEN TOWNB POINT ROAD AND CEDAR LANE, AND TO SIGN
<br />A BOND IN THE AMOUNT OF $1,000. FOR SAID PROJECT.
<br />
<br /> WHEREAS, it becomes necessary from time to time for the City of Portsmouth
<br />to obtain permits from the Virginia Department of Highways to install, construct,
<br />reconstruct, maintain, and operate certain public works along, across, over and
<br />upon the highway system of Virginia; and
<br />
<br /> WHEREAS, expense, damage or injury may be sustained by the Commonwealth of
<br />Virginia growing out of the granting to said City of Portsmouth by the Virginia
<br />Department of Highways of said permits for the work aforesaid; and
<br />
<br /> WHEREAS, one of the conditions of such permit or permits is that the City of Ports%
<br />mouth shall indemnify the Commonwealth of Virginia against all damages and injuries
<br />to the highways and bridges and to persons or property lawfully upon such highways.
<br />
<br /> NOW,' THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Manager be, and he hereby is authorized to apply for a permit from the
<br />Virginia Department of Highways to install a twelve inch ductile iron gravity sewer
<br />between Towne Point Road and Cedar Lane and to sign a bond in the form attached hereto
<br />in the amount of One Thousand and 00/100 ($1,000.) Dollars, for the hereinabove mentione~
<br />project."
