<br />S~ction 2. The~full faith and credit of the City of Portsmouth shall be pledged
<br />~o the payment of the principal of and interest on the Utility Bonds. The principal
<br />and interest of the Utility Bonds shall be payable from ad valorem taxes without limitatio
<br />of rate or amount, if the revenues of the undertaking consisting of the water, sewer
<br />and sewage disposal systems are insufficient for that purpose.
<br />
<br />Section 3. Full power and authority is hereby given the City Manager to date the Utility
<br />Bonds as of any date within the current fiscal year, and to sell the Utility Bonds
<br />in such manner, either at private or public sale, and at such time and place, as the
<br />City Manager may determine; the City Manager is further authorized to sell the Utility
<br />Bonds either together with or separate from any other full faith and credit bonds of
<br />the City authorized for issuance.
<br />
<br /> Full power and authority is hereby given to the City Manager of the City of Portsmout
<br />to prepare and issue the Utility Bonds in such form and for such sum as authorized
<br />by Section 1 hereof~ The said City Manager is authorized to cause to be imprinted
<br />on the back of each of said Utility Bonds a copy of the complete final legal opinion
<br />with respect to said bonds, with name of the attorney or attorneys rendering same, togethe
<br />with a certification of the City Clerk, evidenced by a facsimile signature of that office~
<br />to the effect that the copy is a true and correct copy of the legal opinion which was
<br />dated as of the date of delivery and payment of the bonds.
<br />
<br />Section 4. The Utility Bonds shall not be subject to taxation by the
<br />and the coupons pertaining to said bonds, shall after the maturity of

<br />Secti~m:Bi~TSe U~lity Bonds authorized by this resolution shall not be included in
<br />determining the limitation upon the power of the City to incur indebtedness under the
<br />provisions of Article VII, Section 10, Clause (a)(2)', of the Constitution of Virginia,
<br />but from and after November 2, 1976, whenever and for so long as the revenue producing
<br />undertaking constructed and improved out of proceeds of said bonds fails to produce
<br />sufficient revenue to pay the cost of operation and administration (including interest
<br />on bonds issued therefor, and the cost of insurance against loss or injuries to persons
<br />and property), and an annual amount to be covered into a sinking fund sufficient to
<br />pay at or before maturity all bonds issued on account of said revenue producing undertaki[
<br />All such bonds outstanding shall be included in determining the limitation upon the
<br />power of the City of Portsmouth to incur indebtedness.
<br />
<br />Section 6. All other resolutions or orders, or parts thereof, in conflict with the
<br />provisions of this resolution, are to the extent of such conflict hereby repealed.
<br />
<br />Section 7. This resolution shall take effect from its passage."

<br /> 73~450 - "I submit the attached resolution and recommend its adoption. This
<br />authorizes the City Manager to sign a joint agreement with neighboring political subdivi~
<br />siena concerning the TENPIN Project.
<br />
<br /> The agreement is for the purpose of providing an exchange of data on wanted persons,
<br />persons on probation and parole, persons under surveillance, and stolen articles. The
<br />Cities participating are Norfolk, Virginia Beach, Chesapeake, Portsmouth, Suffolk, Nanse-
<br />mend, Newport News, Hampton, Williamsburg and the County of York. This agreement covers
<br />the fiscal year 1973-74."

<br /> On motion of Mr. Smith and seconded4by Mr. Johnson, the following resolutian was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY t~NAGER TO EXECUTE A JOINT AGREEMENT WITH
<br />NEIGHBORING POLITICAL SUBDIVISIONS CONCERNING THE TENPIN PROJECT.
<br />
<br /> WHEREAS, Section 15.1-21 of the Code of Virginia, 1950, as amended, allows political
<br />subdivisions to enter into joint agreements; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, deems it necessary to
<br />enter into such an agreement for the purpose of providing an exchange of data on wanted
<br />persons, persons on probation and parole, persons under surveillance, and stolen articles,
<br />and further to compliment the Virginia Criminal Information Network (V-CIN), such project
<br />to be known as the TENPIN project.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the certain terms and conditions of an agreement as attached hereto between the
<br />cities of Norfolk, Virginia Beach, Chesapeake, Portsmouth, Suffolk, Nansemond, Newport
<br />News, Hampton and Williamsburg and the county of York relating to the TENPIN system
<br />are hereby approved.
<br />
<br /> BE IT FURTHBR RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager is hereby authorized and directed to execute said agreement."
