<br /> Motion of Mr. King and seconded by Mr. Early, minutes of the regular meeting qf
<br />January 8, 1974, to be approved as received, was adopted by the following vote:

<br />The following reports from the City Manager were read:
<br />
<br /> 74-18 - "I submit the attached ordinance and recommend it be placed on first reading
<br />This ordinance calls for the appropriation of $4,000 for payment of claims made in a
<br />recent suit against the City resolved by an out-of-court settlement."
<br />
<br /> On motion of Mr. King and seconded by Mr. WentZ, the following ordinance was ap-
<br />proved on first reading, and by the following vote:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $4,000 FROM THE GENERAL FUND FOR PAYMENT OF
<br />CLAIMS F~tI)E AGAINST THE CITYi~OF PORTSMOUTH."

<br /> 74~19 - "I submit the attached ordinance and recommend it be placed on first reading.
<br />This appropriates $16,000 from the General Fund for the purpose of refunding the retireme~
<br />contributions to beneficiaries of deceased retirees.
<br />
<br /> Our current operating budget includes the funds to return one-third of all retiree
<br />contributions during this fiscal year. The above funds are required to refund one-third
<br />of the retired deceased contributions to their designated beneficiarieS, This refund
<br />only applies to those employees who retired from the City prior to July 1, 1967."
<br />
<br />Councilman Johnson and Smith entered the CounCil.Chamber during discussion.
<br />
<br /> On motion of Mr. King and seconded by Mr. Holley, the following ordinance wasap-
<br />proved on first reading, and by the following vote:
<br />
<br />"AN ORDINANCE TO AUTHORIZE AND APPROPRIATE $16,000 FROM THE GENERAL FUND
<br />TO REFUND TO DESIGNATED BENEFICIARIES CERTAIN RETIREMENT FUND CONTRIBUTIONS
<br />WHICH HAD BEEN CONTRIBUTED TO SAID FUND PRIOR TO JULY 1, 1967."
<br />

<br />
<br /> 74-20 - "I submit the attached resolution and recommend its adoption. This authoriz~
<br />the sale of surplus City-owned property along Blmhurst Lane extended. This land is
<br />to be sold to Terminal Warehouse Corporation and is surplus to the City's need for the
<br />construction of this street.
<br />
<br /> In exchange for this property, Terminal Warehouse Corporation will transfer to
<br />the City land they own, needed for the construction of Elmhurst Lane extended. The
<br />City will be receiving more square footage than it is disposing of."
<br />
<br /> On motion of Mr. King and seconded by Mr. Smith, the following resolution was adopted
<br />and by the following vote:
<br />
<br /> "A RESOLUTION AUTHORIZING TNE CITY N~NAGER TO ACCEPT THE BID OF TERMINAL
<br /> WAREHOUSE CORPORATION' TO PURCHASE CERTAIN CITY-OWNED PROPER~Y (RESIDUAL
<br /> PARCEL OF ELMHURST LANE EXTENDED).
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, has determined that certain
<br />property, hereinafter described, is surplus property and no longer required for City
<br />purposes; and ', ,.
<br />
<br /> ,WHEREAS, the Council has, bY its resolution of December 18, 1973, authorized the
<br />City Manager to advertise this property for sale upon certain terms and conditions;
<br />and
<br />
<br /> WHEREAS, the City Manager has caused the said property to be advertised in accordance
<br />with the said authorization; and j
<br />
<br /> WHEREAS, Terminal Warehouse Corporation has submitted a bid in response to said
<br />advertisement; and I
<br /> WHEREAS, the Council finds, after due consideration, that the bid of Terminal Wareho~
<br />Corporation complies fully with the terms of the City's advertisement and that the
<br />
