We have notified Portsmouth Gas Company, Virginia Electric and <br />Power Company, and the Chesapeake and Potomac Telephone Company that timely relocation <br />of the utility facilities for construction of a portion of the Western Freeway is necessar' <br />We have received confirmation from the Portsmouth Gas Company that their utilities will <br />be relocated as necessary. To date, we have not received word from the C & P Telephone <br />Company or VEPCO. However, we foresee no problem in obtaining their commitment to do <br />this work. <br /> <br /> This involves mainly the West Norfolk Bridge <br />that this resolution be passed at this time since <br />13th of March." <br /> <br />and its approaches. It is necessary <br />the project is due for bids on the <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the resolution was adopted, and <br />by the following vote: <br /> <br />"A RESOLUTION COi%qlTTING THE CITY OF PORTSMOUTH TO SEEK TIMELY RELOCATION OF <br />CERTAIN UTILITY FACILITIES SO AS TO EXPEDITE CONSTRUCTION OF A PORTION OF THE <br />WESTERN FREEWAY. <br /> <br /> WI~REAS, the State Highway Department proposes to construct the Western Freeway <br />from O.419 miles east of the western branch of the Elizabeth River to O.104 miles east <br />of the Norfolk, Franklin & Danville Railway designated as Highway Project 0164-124-101, <br />C-501; and <br /> <br /> }C4EREAS, this Council is responsible for making arrangements for the adjustment <br />and/or relocation of certain utilities and for the installation of any new facilities; <br />and <br /> <br />WHEREAS, the said utilities are identified as folIows: <br /> <br />Utility Owner <br /> <br />Type of Facility <br /> <br />Portsmouth Gas Company <br />Virginia Electric and Power Co. <br />The Chesapeake and Potomac <br /> Telephone Company of Virginia <br />City of Portsmouth <br /> <br />Gas <br />Ele¢~tric <br /> <br />Communications <br />}gater & Sanitary Sewer <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, <br />that this Council hereby certifies that all arrangements have been made or will be made <br />for the relocation and/or adjustment of said utility facilities, and for the installation <br />of any new facilities. In the event of any justifiable claims from the road contractor <br />for delays or interference caused by said utilities, the City of Portsmouth hereby agrees <br />to be responsible for said claims, provided it may legally do so and further provided <br />that the City is advised in writing by the State Highway Department at the time of delay <br />that the road contractor intends to file a claim.
