March 23, 1999 - Unfinished Business - Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to remove item 99-43(b) from consideration under the Consent Agenda, and was adopted by unanimous vote. 99-43 - Rezoning application: (b) Ordinance granting the request of John B. and Deborah A. Stanley to rezone from C-1-K to C-I-K at 4510 Portsmouth Boulevard. Deferred from March 9,1999 City Council Meeting. (Z-99-01) Motion by Mr. Pitts, and seconded by Mr. Griffin: to refer Item 99-43(b) back to the Planning Commission for further consideration, and was adopted by unanimous vote. CONSENT AGENDA 99-56 - A rezoning, a use permit and street closure: Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following ordinances and resolution, approved at the March 9, 1999 Council Meeting, and was adopted by the following vote: 99-56(a): "ZONING AMENDMENT ORDINANCE Z-98-05" 99-56(b): "A RESOLUTION GRANTING A USE PERMIT TO JOHN AND RHONDA JOHNSON FOR THE OPERATION OF A MARINA, CRAB HOUSE, AND RETAIL OPERATION AT 1128 HARRELL STREET. WHEREAS, John and Rhonda Johnson have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a marina, crab house, and retail operation to be located at 1128 Harrell Street, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or ~mprovements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance.
