March 23, 1999 <br /> <br />- Unfinished Business - <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to remove item 99-43(b) <br />from consideration under the Consent Agenda, and was adopted by unanimous vote. <br /> <br />99-43 - Rezoning application: <br /> <br />(b) <br /> <br />Ordinance granting the request of John B. and Deborah A. Stanley to rezone <br />from C-1-K to C-I-K at 4510 Portsmouth Boulevard. Deferred from March <br />9,1999 City Council Meeting. (Z-99-01) <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Griffin: to refer Item 99-43(b) back to <br />the Planning Commission for further consideration, and was adopted by unanimous <br />vote. <br /> <br />CONSENT AGENDA <br /> <br />99-56 - A rezoning, a use permit and street closure: <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />ordinances and resolution, approved at the March 9, 1999 Council Meeting, and was <br />adopted by the following vote: <br /> <br />99-56(a): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-98-05" <br /> <br />99-56(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO JOHN AND RHONDA JOHNSON <br />FOR THE OPERATION OF A MARINA, CRAB HOUSE, AND RETAIL OPERATION <br />AT 1128 HARRELL STREET. <br /> <br /> WHEREAS, John and Rhonda Johnson have made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of <br />a use permit to operate a marina, crab house, and retail operation to be located at <br />1128 Harrell Street, Portsmouth, Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting said <br />use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the <br />property or ~mprovements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe and <br />convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> <br />
