April 9, 1974 <br /> <br />WRO, persons transferred from Welfare Rolls to Social Security Supplemental Income Rolls, <br />deferred from last meeting. <br /> <br /> Mr. William P. Robinson, Jr., Attorney from Norfolk, Virginia, representing WRO, spoke <br />for Mrs. Fortineau. <br /> <br /> Motion of Mr. Holley and seconded by Mr. Early, that the matter be referred to a <br />conference, was adopted by unanimous vote. <br /> <br /> 74-130 The following report received from the City Attorne~ re: letter of Rev. Ralph <br />Reavis, dated March 27, 1974, was read: <br /> <br /> "You forwarded the above-referenced letter to me for an opinion as to the legality <br />of the request contained therein. Said letter was s~ent to Mayor Barnes by Reverend Reavis <br />in his capacity as president of Bl~ck Urban Developers, Incorporated. Reverend Reavis <br />requested "... support in helping us get an allocation of $200,000 from the Revenue <br />Sharing Pro~ram ... to be "... used for sewage, streets, etc .... "i~'tke~Twi~'Pin~s <br />subdivision. This letter and Reverend Reavi~'s remarks at your March 26, 1974 meeting <br />seemingly urged a direct grant of municipal revenues to Black Urban Developers, Inc., <br />a private organization, for their use in the furtherance of community oriented objectives. <br />As you are aware, the Council's authority to directly appropriate public revenues to pri- <br />vate organizations in severely restricted under law. However, t am not required to con- <br />sider such issue since upon further inquiry and correspondence I have determined that <br />Black Urban Developers, Inc. desires only an allocation of such an amount by the Council <br />for use by the city in the installation of sewer and street improvements in the Twin Pines <br />subdivision. Such an appropriation of funds for use by the city itself in street improve- <br />ments is a proper public purpose well within the Council's legislative authority. <br /> <br /> Therefore, it is my opinion that the requested funds may be legally appropriated for <br />use by the city to install street improvements in the Twin Pines subdivision and that such <br />request may be handled in accordance with your normal procedures concerning proposed al- <br />locations of Revenue Sharing funds. <br /> <br /> Motion of Mr. Smith and seconded by Mr. Holtey, the matter t~ be referred to the <br />Municipal Finance Comm%ssion, was adopted by unanimous vote. <br /> <br /> 74-133 The following report from the City Manager, concerning North Siesta Gardens <br />area, was read: <br /> <br /> "The City Council, at its last meeting, received a letter from the corresponding- <br />secretary of the North Siesta Garden Club concerning sewerage facilities in their <br />area. This letter was referred to the City Manager with a request that a report be <br />made back to Council at its next meeting. The City Council authorized~design Of a necessa: <br />facility for sanitary sewers in the North Siesta Gardens area in October of 1972. There <br />have been several delays in the completion of the final design for these facillfies. <br />Final plans have now been completed and were sent to the State Health Department in <br />January of 1974. The State law allows the State Health Department two months to approve <br />or disapprove the plans. Plans then go to the State Water Control Board which also has <br />two months to approve or disapprove the plans. We expect to receive approval for this <br />project within the next two months. In anticipation of State Water Control Board approval <br />we intend to advertise for bids to be taken on May 15, 1974.. If bids are satisfactory, <br />award of the contract will be made by July 1, 1974. Construction of a required pumping <br />station will be the major factor in completing this project and is expected to take approx: <br />mately 9 months. The sewers should be available for connections by April, 1975L <br /> <br /> The letter from the Garden Club also requested information concerning vacant lots <br />on which owners were unable to build because the City provided no sewerage connections <br />and requested that the City Assessor be instructed to withhold any increase-in property <br />assessments until proper sewage disposal is installed in this area. Lots in Siesta Gardem <br />on which owners have been prevented from building have been determined by the Health <br />Department to be unsuitable for septic tanks. <br /> <br /> The corresponding secretary, Mrs. Spring, has been advised concerning this matter <br />by letter dated April 5 and signed by the City Manager." <br /> <br /> Motion of Mr. Early and seconded by Mr. Smith, the matter to be referred to the City <br />Attorney, was adopted by unanimous vote. <br /> <br /> 74-105 - The following report from the City Manager, concerning 2700 block of <br />Turnpike Road, was read: <br /> <br /> "At its meeting of March 12, 1974, City Council received a petition from residents <br />of the 2700 block of Turnpike Road and members of the First Baptist Church of Taylorsville <br />requesting construction of sidewalks, curbs and gutters in this area. The City Manager <br />was requested to investigate this request and report back to City Council. <br /> <br /> I have been advised by the City Engineer that attempting to improve a short section <br />of this street would be an improper way to proceed with needed construction in this area. <br />Work in this area should be a part of needed improvements to Turnpike Road between Constit <br />tion Avenue and Alexanders Corner. Extensive improvements to the underground drainage <br />system are required to improve and widen Turnpike Road. The City Engineer does not recomm <br />mend piecemeal improvements which would quite likely have to be replaced in the major <br />project which would follow. It appears that the proper solution to this problem is to <br /> <br /> <br />
