<br />At a regular City Council meeting held on April 9, 1974, there were present:
<br />
<br />Jack P. Barnes, E. Saunders Early, Jr., James W. Holley, Burrell R. Johnson,
<br />Isaac W. King, Raymond B. Smith, Robert W. Wentz, Jr., Phin Horton, City Manager,
<br />W. J. O'Brien, Jr,, City Attorney.
<br />
<br />Councilman King offered prayer.
<br />
<br />Mayor Barnes welcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Smith and seconded by JVlr~ Holley, the minutes of the regular~ meeting
<br />of March 26, 1974, to be approved as corrected under Item 74-127 last part o~£-~otion to
<br />read: the cost of enclosing at least one pool to be considered was adopted by the
<br />following vote:

<br />The following reports from the City Manager were read:
<br />
<br /> 74-138 "The attached resolution is submitted for your consideration and I
<br />recommend its adoption. This authorizes and directs the City Manager to convey certain
<br />surplus property to Virginia Port Authority. This piece of property was conveyed
<br />by VPA to the City of Portsmouth for use in the Sea-land Terminal Facility and is not
<br />needed for that purpose. We are required to reconvey this land to VPA in accordance
<br />with Section 10 of the Port Unification Agreement since we do not have use for this
<br />terminal facility and so that it can be used for general port development."
<br />
<br /> On motion~of Mr. Smith and seconded by Mr. Wentz, the following resolution was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO CONVEY CERTAIN
<br />SURPLUS PROPERTY TO THE VIRGINIA PORT AUTHORITY.
<br />
<br /> WHEREAS, the City of Portsmouth and the Virginia Port Authority entered into a
<br />certain agreement known as the Port Unification Agreement dated March 30, 1971; and
<br />
<br /> WHEREAS, Section 10 of said agreement required the Virginia
<br />make property transfers in favor of the City of Portsmouth under
<br />therein; and
<br />
<br />Port Authority to

<br /> WHEREAS, the Virginia Port Authority on September 27, 1975, conveyed a certain
<br />parcel of land to the City of Portsmouth pursuant to the hereinabove mentioned agreement
<br />and
<br />
<br /> WHEREAS, a portion of the property conveyed on September 27, 1973, is no longer
<br />needed by the City and is surplus; and
<br />
<br /> WHEREAS, such portion is required to be conveyed to the Virginia Port Authority
<br />by said Section 10 of the hereinabove mentioned agreement.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Manager be, and he hereby is authorized and directed to convey the followin
<br />described property to the Virginia Port Authority:
<br />
<br />That certain tract, piece or parcel pf land situate in the Pinners Point
<br />section of the City of Portsmouth being more particularly bounded and
<br />described as follows, towit:
<br />
<br /> Beginning at a point on the pierhead line of the Western Branch of
<br />the Elizabeth River, said point bearing North 50019'54'' West a distance
<br />of 700.85 feet along the pierhead line of the Elizabeth River and South
<br />88°54'50'' West a distmnce of 642.14 feet along the pierhead line of the
<br /> Western Branch of the Elizabeth River from the intersection of the
<br />northwestern property line of the Elizabeth River Tunnel District and
<br />the pierhead line of said Elizabeth River; thence from said true point
<br />of beginning South 06~4'33'' West a distance of 687.81feet to a point;
<br />thence North 83015'27" West a distance of 275.00 feet to a point, said
<br />point being on the eastern boundary line of property of the Virginia
<br />Port Authority; thence North 06°44~33'' East a distance of 650.00 feet
<br />along said boundary line to a point, said point being on the pierhead
<br />tine ~f the Western Branch of the Elizabeth River; thence North 88054'
<br />50" East a distance of 277.59 feet along said pierhead line to the point
<br />of beginning.

<br /> IT BEING a part of the same property conveyed to the Grantor, by deed
<br />of the Virginia Port Authority duly recorded in the Office of the Clerk
<br />of the Circuit Court of the City of Portsmouth, Virginia (formerly the
<br />Court of Hustings) in Deed Book 630, at page 588.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is directed to
<br />complete all transactions and execute all documents incident to the above-referenced
<br />conveyance."
