298 <br /> <br />June 10, 1974 <br /> <br />Academy; thence southerly along said line approximately 160 feet; <br />thence easterly along the property line of the American Lodge <br />approximately 270 feet to the south right of way line of Hodges Ferry <br />Road; thence northerly along said right of way approximately 160 feet <br />to the point of origin." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Barnes <br />Nays: None <br /> <br />Use Permit 74-5 Petition of Associated Churchland Investors <br /> <br />J. Preziotti, Jr., -Planning.Consultant, spoke for Associated Churchland Investors. <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR THE CONSTRUCTION AND OPERATION <br />OF A SEWAGE PUMPING STATION ON WOODSIDE LANE {UP-?4-S). <br /> <br /> WHEREAS, the Associated Churchland Investors has made an application pursuant <br />to Section 40-67 of the Code of the City of Portsmouth, Virginia, 1975, for the granting <br />of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required <br />to be done in connection with said application, and the Planning Commission has recommende <br />the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />A. That the use for which the use permit hereinafter described is sought <br />(1) will not.adVersely affect the health or safety of persons residing or <br />working zn theCne~ghbprhood of the proposed use, {2) will not be detrimental <br />to the public welfare or injurious to property or improvements in the <br />neighborhood, and ($) will be in accord with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br />B. That Associated Churchland Investors is hereby granted a use permit, <br />subject to site plan restrictions, pursuant to Section 40-67 of the City <br />Code for the construction and operation of a sewage pumping station <br />located on the property described as follows: <br /> <br /> Beginning on the south right of way line of Woodside Lane approximately <br />SSS feet west of tke'so~tmees~ corner of Southampton Arch and Woodside Lane; <br />thence southwest approximately 170 fe~t; thence northwest approximately SO <br />feet; thence northeast approximately SO feet; 'thence southeast approximately <br />$S feet; thence northeast approximately 120 feet to Woodside Lane; thence <br />southeast 1S feet to the point of origin."- <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Barnes <br />Nays: None <br /> <br />Motion of Mr. Smith and seconded by Mr. Johnson, the meeting adjourned at 7:45 p.m. <br /> <br />APPROVED <br /> <br />City Clerk <br /> <br /> <br />
