Saunders Early, Jr., James W. Holley, Burrell R. Johnson, <br />Isaac W. King, Raymond B. Smith, Phin Horton, City Manager, D. R. Hagemeister, <br />Acting City Attorney. <br />Absent: Robert W. Wentz, Jr. <br />Prayer was offered by Councilman King. <br /> <br />Mayor Barnes welcomed all visitors in attendance. <br /> <br /> 74-226 Public Hearing on the following rezoning applications, a proposed <br />Subdivision OrdiRanaeAmendment, and use permits: <br /> <br />Zoning Petition Z 74-4 Petition of Roy D. and Paige M. Taylor, Owners <br /> <br />J. Wayne Boggs, 101 Charlotte Drive, spoke against Z 74-4. <br /> <br /> Motion of Mr. Smith and seconded by Mr. King, that the following ordinance be approve{ <br />on first reading, and was adopted by the following vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 74-4" <br /> <br />AMes: Early, Holley. Johnson, King, Smith, Barnes <br />Nays: None <br /> <br />Zoning Petition Z 74-5 Petition of Amelia G. McLean <br /> <br />C. Raeford Eure, Agent for Amelia G. McLean, spoke in favor of Z 74-5. <br /> <br /> Motion of ~Mr. Smith and seconded by Mr. Early, that the following ordinance be <br />approved on first reading, and was adopted by the following vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 74-5" <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Barnes <br />Nays: None <br /> <br />The following .Amendment to the Subdivision Ordinance was read: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTION 32-24 THEREOF PERTAINING TO REQUIREMENTS FOR FINAL SUB- <br />DIVISION PLATS." <br /> <br /> On motion of Mr. King and seconded by Mr. Smith, the ordinance was approved on first <br />reading, and by the following vote: <br /> <br />Ayes: Early, Hotle'y, Johnson, King, Smith, Barnes <br />Nays: None <br /> <br /> Use Permit 74-4 - Petition of C & P Telephone Company of Virginia <br /> Vann H. Lefcoe, Attorney, spoke for C & P Telephone Company. <br /> On motion of Mr. King, and seconded by Mr. Smith, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR THE CONSTRUCTION AND OPERATION OF <br />A STATION HOUSING TELEPHONE SWITCHING EQUIPMENT (UP-74-4]. <br /> <br /> WHEREAS, the Chesapeake ~ Potomac Telephone Company of Virginia has made an applicati( <br />pursuant to Section 40-67 of the Code of the City of Portsmouth, Virginia, 1973, for <br />the granting of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required <br />to be done in connection with said application, and the Planning Commission has recommendei <br />the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />A. That the use for which the use permit herinafter described is sought <br />~t) ~1 not adversely affect the health or safety of Persons residing or ~ <br />working in the neighborhood of the proposed use, (2) will not be detri- <br />mental to the public welfare or injurious to property or improvements <br />in the neighborhood, and ($) will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br />B. That theIChesapeake ~ Potomac Telephone Company of Virginia is hereby <br />granted a use permit, subject to site plan restrictions, pursuant to Section <br />40-67 of the City Code, for the construction and operation of a Station <br />housing telephone switching equipment located on the property described as <br />follows: <br /> <br /> Beginning on the west side of Hedges Ferry Road approximately 590 feet <br />South of its southwest intersection with Portsmouth Boulevard; thence <br />westerly approximately $00 feet to the property line of the Central Christian <br /> <br /> <br />
