361 <br /> <br /> .WFLEREAS¥ the City Council is in receipt of a request from the Commonwealth's <br />Attorney of the City of Portsmouth to develop and implement a comprehensive position <br />classification and pay plan for the Office of the Commonwealth's Attorney, in order <br />to attract and/or retain qualified Assistant Commonwealth's Attorneys; and <br /> <br /> WHEREAS, it is the sense of the Council that an increase in basic salaries in <br />conjunction with the establishment of a position classification and pay plan for <br />the Office of the Commonwealth's Attorney, is in the best interest of the City of <br />Portsmouth. <br /> <br /> NOW, T[~REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized and directed to prepare a position <br />classification and pay plan for the Commonwealth's Attorney's Office and to submit such <br />plan to the State Compensation Board for approval." <br /> <br /> Ayes: Early, Eltiott, Holley, Oast, Wentz, Davis <br /> Nays: None <br /> <br /> 74-367 - "Consideration of a resolution to authorize the City Manager and the <br />Director of Public Utilities to execute and submit certgin applications to the Environ- <br />mental Protection Agency. <br /> <br /> Federal Water Pollution Control Act Amendments of 1972 provided for reimbursement <br />to communities who had previously constructed eligible facilities but did not receive <br />the maximuml grant allowance~zat the time of construction. In order for the City to meet <br />the eligible requirements it is necessary that a representative, by name and title, be <br />authorized by the Governing Body to execute and file all documents regarding the projects <br />The City Manager recommends adoption of the resolution." <br /> <br /> On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was <br /> adopted, and by the following vote: <br /> <br /> "A RESOLUTION TO AUTtiORIZE TIlE CITY I~JINAGER AND TttE DIRECTOR OF PUBLIC <br /> UTILITIES TO EXECUTE AND FORWARD APPLICATIONS AND RELATED DOCUMnNTS TO THE <br /> ENVIRO~MENTAL PROTECTION AGENCY, 'UNITED STATES OF AMERICA, FOR THE GRANT <br /> OF FEDERAL FUNDS FOR THE CONSTRUCTION OF WASTE grATER TREATMENT FACILITIEs. <br /> <br /> WHEREAS, the Federal Water Pollution Control Act, as amended in 1972, Provides <br />for reimbursement to communities which had previously constructed waste water facilities <br />deemed eligible for Federal grant assistance but did not receive the maximum grant al- <br />lowable at the time of construction; and - <br /> <br /> WHEREAS, the Director of Public Utilities has advised the City Council that <br />the City of Portsmouth has constructed facilities which are eligible for said reimburseme <br />and <br /> <br /> WHEREAS, the Environmental Protection Agency requires that the governing body of <br />the applicant for said reimbursement authorize a representative, by name and title, <br />to execute and forward applications and related documents. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, <br />that the City Manager, Phin Horton, and the Director of Public Utilities, P. J. Brady, <br />are each hereby authorized and directed to execute and forward any and all applications <br />and related documents on behalf of the City of Portsmouth, Virginia, to the Environmental <br />Protection Agency for the grant of reimbursement funds for previously constructed and <br />eligible waste water treatment facilities, in accordance with the provisions of the <br />Federal Water Pollution Control Act Amendments of 1972." <br /> <br /> yes. Early, Elliott Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 74-368 "Consideration of a resolution authorizing and directing the City Attorney <br />to institute eminent domain proceedings for property located near the intersection of <br />Airline~Boulevard and Victory Boulevard. <br /> <br /> This resolution directs the City Attorney to institute condemnation proceedings <br />for a parcel of land located at the northeast corner required for widening and extension <br />of Victory Boulevard to Portsmouth BOu}~vard. The City Manager recommends adoption of <br />the resolution." <br /> <br /> On motion of Mr. Early and seconded by Mr. Ilolley, the following resolUtion was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE <br />CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DObbIN PROCEEDINGS PURSUANT <br />TO CHAPTER 471 OF THE ACTS OF ASSEMBLY OF 1970, AS ~4ENDED, SAID PROPERTY <br />BEING NECESSARY FOR THE WIDENING OF AIRLINE AND VICTORY BOULEVARDS. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest <br />hereinafter specified in and to the hereinafter described parcel of land situate in <br />the City of Portsmouth, Virginia, for the purpose of widening Airline and Victory Bouleva~ <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described <br />herein, necessary to the project, because the o~ers thereof and the City have not been <br /> <br /> <br />
