<br /> "A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF SOUTHERN AVENUE
<br /> BETWEEN PAGE STREET AND HILL AVENUE.,
<br />

<br /> ~%~EREAS, Portsmouth Terminals, Inc. has made application to.vacate and close the
<br />hereinafter described portion of a certain street, and it appearing that notice of
<br />the application and request for the appointment of viewers was duly posted on the bulletin
<br />board of the Circuit Court of the City of Portsmouth, and in two other public places
<br />in said City, at least 10 days prior to September 10, 1974.'
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that Frank N. Bilisoly, Joseph C. Barber, Belvin W. Blachman, Zalmon t. Blachman and
<br />James L. Choate, be appointed viewers to view the hereinafter described portion of
<br />such street and report to this Council in writing, whether in their opinion, any, and
<br />if any, what inconvenience would result from vacating and closing the following:
<br />
<br /> All that certain lot or parcel of land situate in the City of Portsmouth,
<br />~irginia, and described as follows:
<br />
<br /> Southern Avenue from its intersection with the center line of~Page Street,
<br />extended, six hundred and five (605) feet in a westerly direction to a line
<br />approximately 75 feet east of the eastern right of way of Eill Avenue."
<br />
<br /> Mr. Carl J. Ward, Ward Investments, Inc., requested to speak in letter dated July
<br />10, 1974, when resolution was to be presented.
<br />
<br />Mr~ Ward spoke.
<br />
<br /> On motion of Mr. Elliott and seconded by Mr. Barnes, the resolution to be deferred
<br />until a study can be made and proper informaton be submitted to the Council by the City
<br />Attorney, was adopted by the following vote:
<br />
<br />Ayes: Barnes, Early, Elliott, Holley, Wentz, Davis
<br />Nays: Oast

<br /> 74-342 - The following ordinance, deferred from meeting of August 27, t974, was
<br />taken up and read:
<br />
<br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973,
<br />BY AMENDING SECTION 8-27 THEREOF PERTAINING TO SURETY'S FEES FOR BAIL BONDS."
<br />
<br /> Mr. Robert L. Pruitt, Jr., 3744 Shoreline Drive, Bondsman, spoke~in favor of the
<br />ordinance.
<br />
<br /> The following request to speak received from Rev. Charles Kettlewell, Portsmouth
<br />Urban Ministry Project, was read:
<br />
<br /> HPermission is hereby requested for me to speak on th~ above matter at the meeting
<br />of the City Council meeting of Tuesday, September tenth."
<br />
<br />Rev. Kett!ewell spoke against th~.ordinance.
<br />
<br /> Motion of Mr. Barnes and seconded by Mr. Y~ntz, that the ordinance to be deferred
<br />to the first meeting in October (October 8, 1974); the bondsmen furnish more statistical
<br />info~mation and any~a~her person with information may appear, was adopted by the following
<br />vole:

<br /> 74-345 The following franchise agreement between the City of Portsmouth, Virginia
<br />and Cox Cable of Portsmouth, Inc., was presented:
<br />
<br /> "This agreement expressly authorized
<br />being entered into prusuant to the August
<br />Virginia to Cox Cable of Portsmouth, Inc.
<br />communications system in Portsmouth.
<br />
<br />by the City Council on September 10, 1974 is
<br />13, 1974 grant by the City Council of Portsmouth
<br />of a franchise to operate a cable television
<br />
<br />The parties agree that Chapter 6 1/2 of the Portsmouth ViYginia Code entitled
<br />'.'Cable Television Communications System" shall govern the franchise issued to
<br />Cox Cable of Portsmouth, Inc. and the rights and obligations that follow there-
<br />from.
<br />
<br />The parties agree that any action taken pursuant to this agreeme~ shall be
<br />governed by the Cable Television Communications Chapter of the Portsmouth Code
<br />and that any amendment or change in such Chapter shall become part of this
<br />
<br /> 3. The term of this agreement shall be from August 13, 1974 and for such time as
<br />~ provided in the Cable Television Communications Chapter of the Portsmouth Code.
