392 <br /> <br />October 22, 1974 <br /> <br /> WHEREAS, Title 15.1, Section 431 of the Code of Virginia, 1950, as amended., sets <br />forth minimum public notice requirements for council action on zoning matters; and <br /> <br /> WHEREAS, the current schedule of the Planning Commission public hearing and the <br />City Council meeting to consider zoning matters does not pro-vide sufficient time for <br />compliance with the aforementioned public notice requirements; and <br /> <br /> WHEREAS, it is the sense of this council that the interests of the City of Portsmouth <br />would best be served by altering the schedule of the December meeting so as to permit <br />compliance with the aforementioned public notice requirements. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the meeting of council currently scheduled for December 2, 1974, be rescheduled <br />for December 16, 1974, at 7:30 P.M. in the Council Chamber at the Municipal Building." <br /> <br />Ayes: Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br />UNFINISHED BUSINESS - <br /> <br /> 74-406(1) The following ordinance, approved on first reading at the Public Hearing <br />meeting of October 7, 1974, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF~THE' CITY OF PORTSMOUTH, VIRGINIA, 1923, <br />By AMENDING SECTION 40-31 OF SAID-CODE PERTAINING TO DEFINITIONS." <br /> <br /> On motion of Mr, <br />by the following vote: <br /> <br /> Wentz and seconded by Mr. Elliott, the ordinance <br /> <br />Ayes.: Early, Eltiott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br />was adopted, and <br /> <br /> ?4-407 The fctlowing ordinance, approved on first reading at the Public Hearing <br />meeting of October 7, 1974, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY ADDING THERETO A NE~ CHAPTER NUMBERED 40.1 PERTAINING TO FLOOD CONTROL <br />MANAGF~4ENT." <br />See motion below <br />The following report from the City Attorney was presented: <br /> <br /> "Exhibit B attached hereto is a proposed amendment to the Flood Control Ordinance <br />which will be considered on second reading tonight. This proposed amendment allows <br />the City Building Official no grant variances from the strict terms of the Elood Control <br />Ordinance for structures which are of historical significance. The Department of Lmw <br />has checked with the appropr%ate official of HUD in Philadelphia and they have indicated <br />that this amendment is acceptabl~.
