<br /> ~EREAS, this Council, on behalf of the City of Portsmouth, possesses the
<br />ity to apply for a grant and execute the proposed program under the provisions
<br />aforementioned Act; and
<br />

<br /> WHEREAS, this Council recognizes its responsibility to direct that safeguards be
<br />established to prohibit employees from using their positions for a purpose that is or given
<br />the appearance of being motivated by a desire for private gain for themselves or others,
<br />particularly those with whom they have family, business or other ties.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the 1975 Community Development Program has been reviewed and considered and hereby
<br />is, approved in all respects and that the Mayor and City Manager be, and they hereby are
<br />authorized to file an application and such additional information as may be required for
<br />the City's full 1975 entitlement totalling $4,536,000 under this program.
<br />
<br /> BE IT FURTHER RESOLVED that the Mayor and the City Manager are designated as the Certify
<br />ing Officers and authorized representatives of the City of Portsmouth and shall provide
<br />assurances as required by the regulations of the Housing and Community Development Act of
<br />1974 for 'the approval and execution of such program.
<br />
<br /> BE IT FURTHER RESOLVED that the Mayor and the City Manager be, and they hereby are,
<br />authorized and directed to give the Department of Housing and Urban Development and the
<br />Comptroller General through any authorized representative access to and the right to examine
<br />all records, books, papers, or documents related to the grant.
<br />
<br /> BE IT FURTHER RESOLVED that the Mayor and the City Manager be, and they hereby are,
<br />authorized and directed to execute a contract with the Portsmouth Redevelopment and Housing
<br />Authority for the execution of the Redevelopment Program in accordance with Title 36 of
<br />the Code of Virginia, as amended."

<br /> 74-520 - ':Consideration of a resolution authorizing the City Manager to incur costs
<br />in connection with the preparation and execution of a Community Development Program appli-
<br />cation.
<br />
<br /> The costs to be incurred prior to final approval of the Community Development appli-
<br />cation will not exceed $Z3S,000 and this includes the previous authorization of $S,000.
<br />The City Manager recomfaends approval of this resolution."

<br /> On motion of Mr. Holley and seconded by Mr. Barnes, the following resolution was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORI2ING THE CITY MANAGER TO INCUR COSTS IN CONNECTION WITH
<br />T~ PREPARATION OF A COMMUNITY DEVELOPMENT PROGRAM APPLICATION.
<br />
<br /> I~EREAS, final regulations implementing the Housing and Community Development Act of
<br />1974 were published in the Federal Register on November 13, 1974; and
<br />
<br /> ~HEREAS, certain planning activities must be undertaken by the City of Portsmouth in
<br />connection with the preparation of an application to the Department of Housing and Urban
<br />Development for community development funds and other activities must be undertaken as a
<br />prerequisite to the timely initiation of the program; and
<br />
<br /> WHEREAS, the aforementioned regulations authorize localities to incur costs as of Novemb
<br />13, 1974, the effective date of these final regulations for the planning and preparation
<br />of a community development application.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED, that the City Manager be, and he hereby is, authorized
<br />to incur costs for necessary activities in conjunction with the planning and preparation
<br />of a community development application for the City of Portsmouth for the 1975 fiscal year.
<br />
<br /> BE IT FURTHER RESOLVED that said activities will include, among other matters, prelimina
<br />real estate acquisition work and engineering studies of the project area.
<br />
<br /> BE IT FURTHER RESOLVED, that reimbursement for such expenditures will be dependent
<br />upon the availability of community development funds after January 1, 1975, and upon sub-
<br />mission of an acceptable community development application to,the Department of Housing
<br />and Urban Development in accordance with the regulations.
<br />
<br /> BE IT FURTHER RESOLVED that costs authorized to be incurred pursuant to this resolution
<br />shall be limited to the sum of Two }~ndred Twenty-five Thousand and 00/100 ($225,000.) Dollar
<br />
<br /> BE IT FURTHER RESOLVED that the costs authorized by this resolution include the sum
<br />of Five Thousand and 00/100 ($5,000.) Dollars, authorized by the resolution of this Council
<br />dated December 3, 1974, which resolution is superseded by this resolution."
