April 13, 1999 <br /> <br /> (d) Will be a project that will be developed according to a plan for <br /> parking, driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Helena Robinson is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child <br />day care facility on property located at 2115 High Street, and being more particularly <br />described as: <br /> <br />UP-99-03 <br /> <br />Beginning at a point 120'+ from the southeast corner of the <br />intersection of High Street and Harbor Drive; thence, south 221'+ <br />to a point; thence, east 60'+ to a point; thence, north 110.5'+ to a <br />point; thence, east 5'+ to a point; thence, north 110.5'+ to a point; <br />thence, west 65'+ to the point of the beginning. <br /> <br />3. That this amended use permit is approved subject to the following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to thirty children over the <br />age of 2 ½ years of age and nine children under the age of 2 ½ years of age, for a total <br />of thirty-nine children. <br /> <br /> (b) The hours of operation shall be from 6:00 A.M. through 6:00 P.M., <br />Monday through Saturday. <br /> <br /> (c) The outside play area shall be 2,600 square feet, covered with <br />sand or another surface treatment, located at the rear of the structure and shall be <br />enclosed by 4' high fencing. Outdoor recreational activities shall be limited to the hours <br />between 8:00 A.M. and 6:00 P.M. <br /> <br /> (d) The facility shall be developed in accordance with the submitted <br />floor plan, identified as Exhibit A, attached hereto and made a part hereof. <br /> <br /> (e) Drop off and pick up of children shall be limited to the rear parking <br />area off of King Street. <br /> <br />(f) Staff parking shall be limited to the rear parking area. <br /> <br /> (g) The facility shall comply with all applicable federal, state, and local <br />codes, ordinances and regulations and shall obtain and maintain in effect all necessary <br />licenses and permits. <br /> <br /> (h) The facility shall submit to all required inspections by the Fire <br />Department and the Building Official and shall correct any noted deficiencies. <br /> <br /> (i) <br />paid when due. <br /> <br />All taxes and fees on the subject property and operation shall be <br /> <br /> 4.
